 ° .
0 0
s y- C ITY o ORONO

,'' RESOLUTION OF THE CITY COUNCIL
kESHOg' NO. e`3   D ;
B. The only feasible site for replacement of the existing system is 97' from
the Ordinary High Water mark of French Lake.
C. Zoning Code Section 10.5b, Subdivision 16 (C) requires that any septic
system be located at least 150' from a Natural Environment Lake. The
property was developed prior to adoption of the 150' setback, and the
configuration and layout of ecisting improvements on the property make
it impossible to locate a septic system at a conforming location on the
property.
D. The proposed system has been designed to meet all the pertinent State
standards.
E. Granting of the proposed variance will have no impact on neighboring
properties and will have a positive impact on the quality of French Lake
by allowing the replacement of non-conforming septic system with one
that is expected to provide adequate sewage treatment in all anticipated
ground water conditions.
4. The City Council has considered this application including the findings and
recommendations of the Planning Commission, reports by City staff, comments
by the applicant and the efFect of the proposed variance on the health, safety and
welfare of the community.
5. The City Council finds that the conditions esting on this property are peculiar
to it and do not apply generally to other property in this zoning district; that
granting the variance would not adversely affect traffic conditions, light, air nor
pose a fire hazard or other danger to neighboring property; would not merely
serve as a convenience to the applicant, but is necessary to alleviate a
demonstrable hardship or difficulty; is necessary to preserve a substantial
property right of the applicant; and would be in keping with the spirit and
intent of the Zoning Code and Comprehensive Plan of the City.
