A building permit application has been filed for a swimming pool located at 1300 French Cre� <br /> rive the("Subject Property"),Iegally described as Lot 7. Block 2, French Creek,City of Orono, Nennepin Cour <br /> linnesota. <br /> 2. Owners request the City to review this application. <br /> 3. The City wiil commence its review of the application and incur costs associated with said reviE <br /> �ly if the Owner establishes an escrow to ensure reimbursement to the City of its costs. <br /> OW THEREFORE,THE PARTIES AGREE AS FOLLOWS: <br /> 7. DEPOSIT OF ESCROW FUNDS. Contemporaneously with the execution of ihis Escrc <br /> greement, the�wners shall deposit�2,500 with the City. Ail accrued interest, if any,shall be paid to the City <br /> �imburse the City for its cost in administering the escrow account. <br /> 2. PURPOSE OF ESCROW.The purpose of the escrow is to guarantee reimbursement to the C <br /> �r all out-of-pocket costs the City has incurred (nciuding planning, engineering, in excess of 5500, or lec <br /> �nsultant review} or will incur i� reviewing the plan. Eligible expenses shall be consistent with expenses ti <br /> �wners would be responsible for under' a building permit appiicatian. The escrow wii� also guarant� <br /> �imbursement to the City for all out-of-pocket costs the City has incurred to assure that the work is completed <br /> �cordance with the Stormwater Poliution Prevention Pian and the provisions of Orono City Code Chapter i <br /> he financial security may also be used by the City to eliminate any hazardous conditions associated with tl <br /> ork and to repair any damage to public property or infrastructure that is caused by the work(inciuding plannir <br /> ngineering, or legal consuitant review) associated with buiiding permit #2012-00303 if compliance with tl <br /> pproved buiiding permit is not accomp{ished. <br /> 3. MONTHLY BILLING. As the City receives consultant bills for incurred costs, the City witi in tu <br /> �nd a bili to the Owners. Owners shall be responsible for payment to the City within 30 days of the Owne <br /> �ceipt of bili. <br /> 4. DISBURSEMENT FROM ESCROW ACGOUNT. In the event thai the Owners do not make payme <br /> �the City within the timeframe outlined in#3 above,shail issue a Stop Work Order until the Owners pay ali expens <br /> voiced pursuant to #3. The City may draw from the escrow account without further approval of the Owners <br /> �imburse the City for eligible expenses the City has incurred. <br /> 5. CLOSING ESCROW. The Baiance on deposit in the escrow, if any, shall be returned to t! <br /> �wners when the�eview has been compieted and written notification is received from the Owners requesting tl <br /> inds. <br /> 6. CERTIFY UNPAID CHARGES.
