Chapter 54 deals with solid waste management,which is unrelated to zoning, and <br /> those standards could be included in there. <br /> Bremer and McMillan concurred those standards could be included in Chapter 54. <br /> McMillan noted the City's code also says that trash needs to be picked up every week,but with the <br /> addition of organics recycling,that has allowed some people to go every other week for pickup,which is <br /> something to consider when revising the code. <br /> Gaffron indicated Staff would like to bring back what hopefully is the final version at the next City <br /> Council meeting. <br /> The City Council took no formal action on this item. <br /> 4. #13-3601 CITY OF ORONO—WETLANDS—ZONING ORDINANCE AMENDMENT <br /> Gaffron noted this item was reviewed at the May 20�'Planning Commission meeting, and on a vote of 6-0 <br /> the Planning Commission recommended approval of the ordinance as drafted. There were no public <br /> comments regarding this application at that time. Gaffton noted this is the first time the City Council will <br /> be seeing this ordinance amendment. <br /> Since the Planning Commission meeting, Staff has noted that the proposed 35-foot setback requirement as <br /> drafted does not prohibit hardcover within the wetland setback area; although,the preamble text before <br /> the table does contemplate this with the wording"separation between wetlands and buildings or other <br /> structures or surfaces. Staff believes that in order to provide the protection intended by the 35-foot <br /> setback requirement, it must apply to hardcover surfaces. The City's wetland setback requirements in <br /> place prior to 2005 prohibited hardcover within the historically established 26-foot wetland setback area. <br /> Gaffron stated the City discovered with the Stonebay development that the developer was fine with <br /> constructing right up to the setback line and that the City wanted each home to have a yard around the <br /> home. In an effort to prevent that,the City required, in addition to the buffer requirements,a 20-foot <br /> setback from the buffer for any structures above the ground to provide for that walk-around area. <br /> Page 9 of 18 _ <br />
