• MINUTES OF THE <br /> , ORONO CITY COUNCIL MEETING <br /> Monday,March 11,2013 <br /> 7:00 o'clock p.m. <br /> (7. #13-3591 ERVIN WACHMAN—OUTLOT C BAYSIDE FARMS 2"'D— <br /> SUBD/PRELIMINARYPLAT—RESOLUTIONNO. 6209, Continued) <br /> The Council should consider adopting the attached resolution approving the preliminary plat. <br /> Levang asked if the Geffres have been notified of the email that has been received today. <br /> Curtis indicated they have not and that they are not technically a part of this application. Curtis indicated <br /> she will be in communication with the Geffres but that she does not have their email address. Curtis <br /> noted the email has been provided to the applicant. <br /> McMillan asked if the resolution contains language to the effect that the Geffres need to hook their <br /> driveway into the new road. <br /> Curtis indicated it does. <br /> McMillan asked if they were the homeowners then as well. <br /> Curtis indicated the Geffres signed that agreement. <br /> McMillan asked if the one shade tree for every 40 feet of road frontage is in the code or the conservation <br /> design. <br /> Curtis indicated it is in the City's Code under subdivisions. <br /> McMillan asked what the road frontage is defined as it relates to the planting of the trees. <br /> Curtis stated it would be the frontage along the new private road that is created. Curtis displayed the <br /> landscape plan on the overhead. Curtis pointed out the location of the proposed trees. <br /> McMillan asked if the tree preservation was put in the resolution. <br /> Curtis stated the applicant did provide a report and a plan which is what is referred to in the resolution. <br /> McMillan asked what would happen once the trees die along the road and conservation easement. <br /> Curtis stated the trees protected under the conservation easement are existing trees and the conservation <br /> easement would prevent the cutting and removal of those trees. Curtis indicated if they die naturally, she <br /> is not sure of a provision in the plan on whether additional trees would be added. The applicant is <br /> providing the City with the homeowner association documents but the City is not involved in that. In the <br /> areas where there is invasive species removal,there are plantings proposed for those areas. <br /> Mattick stated he oftentimes will quickly review the homeowner association documents but that he does <br /> not do much more than that since the City is not involved with that. T'he City typically will require <br /> replacement of a tree if it dies within two years of planting,but if a tree dies five years from now,the City <br /> would not go out and enforce the planting of a new tree. <br /> Levang asked if the pines trees are intended to stay along Bayside. <br /> Page 11 of 27 <br />
