"Marginally Common" Structures/Uses <br /> These are structures or uses which are not found at most residential properties but which do exist on some <br /> properties in Orono. Some of these items might be better addressed as Conditional Uses rather than <br /> Accessory Uses. Table 3 (attached) list these uses or structures and notes existing applicable code <br /> sections as well as sample standards for discussion. <br /> Sample Code Language: Prohibition of Unlisted Uses <br /> A number of cities' codes contain language specifying that if a use is not listed as permitted, conditional <br /> or accessory within a zoning district, it is simply not allowed.Here are a few examples of such language: <br /> Maple Grove Sec. 36-211 <br /> "This article sets forth uses that are allowed in residential districts. If a use is not shown as a permitted, <br /> conditional or accessory use, it shall not be permitted." <br /> Wa,yzata Section 801.01.7 (Identical to Maple Plain 153.022) <br /> "Uses Not Provided Within Zoning Districts: Whenever in any zoning district a use is neither specifically <br /> allowed nor denied,the use shall be considered prohibited. In such cases,the City Council or the Planning <br /> Commission, on their own initiative or upon request,may conduct a study to determine if the use is <br /> acceptable and if so what zoning district would be most appropriate and the determination as to conditions <br /> and standards relating to development of the use. The City Council,Planning Commission or property <br /> owner,upon receipt of the staff study shall, if appropriate, initiate an amendment to this Ordinance to <br /> provide for the particular use under consideration or shall find that the use is not compatible for <br /> development within the City." <br /> Minnetonka Section 300.10 <br /> "3. Accessory Uses. Within the R-1 District only the following uses shall be permitted as accessory uses, <br /> provided they are subordinate to, and associated with and located on the same lot as a permitted use:" <br /> Gaffron noted this is something that the City has taken for granted but it has never been incorporated into <br /> the City Code. <br /> Mahtomedi Section 11.01, Subd. 6A <br /> "6.0 Interpretation and Application. The provisions of this ordinance shall be the minimum requirements. <br /> A. Except as otherwise provided in this Ordinance,the following shall apply to a use not provided <br /> for within a zoning district: <br /> 1.
