. �e <br /> ` 'Q�' ��I' <br /> O O <br /> �b�- CITY of OROND <br /> ,� �., ii <br /> ti <br /> �� �'�' RESOLUTION OF THE CITY COUNCIL <br /> �9kESH�S�`� NO. e4 (1 1B. �1 <br /> A RESOLUTION GRANTING A VARIANCE <br /> TO NIUNICIPAL ZONING CODE <br /> SECTION 10.25, SUBDIVISION 6(B), <br /> FILE NO. #2336 <br /> WHEREAS, Bruce Newton (hereinafter "the applicant") is the owner of the <br /> property located at 3580 Frederick Street within the City of Orono (hereinafter "the City") and <br /> legally described as follows: <br /> Lots 17 and 18, Block 2, Navarre (hereinafter "the property"); and <br /> WHEREAS, the applicant has applied to the City for an after-the-fact variance <br /> to Municipal Zoning Code Section 10.25, Subdivision 6(B) to permit the retention of a deck <br /> replacement on the north side of the residence that encroaches into the required rear yard <br /> setback. <br /> NOW, THEREFORE, BE IT RESOLVED by the City Council of Orono, <br /> Minnesota: <br /> FINDINGS <br /> 1. This application was reviewed as Zoning File #2336. <br /> 2. The property is located in the LR-1C Single Family Rural Residential Zoning <br /> District requiring .5 acre in area. The property consists of 14,000 s.f. or .32 <br /> acre. <br /> 3. The Orono Planning Commission reviewed this application on February 17, 1998 <br /> and recommended approval of the proposed variance based upon the following <br /> findings: <br /> 1. The deck w�as a replacement of a previously existing one of similar size. <br /> 2. The rear yard functionally serves as the side yard. <br /> Pa�e 1 of 4 <br />
