Article V, Division 3 of City Code requires use of clean fill as defined in Section 78-1. <br /> The material imported to this property was natural and meets the definition of clean fill. <br /> Applicant is also required to submit adequate plans for the fill. This has been done and the <br /> plans have been approved by City Engineer. <br /> Re: Items 6 & 7. These criteria essentially ask whether the proposed new grade is appropriate <br /> and in character with the surrounding land and neighborhood. Staff believes the fill as it exists <br /> today will have no impact on surrounding lands. Drainage patterns for runoff leaving the site <br /> are not significantly altered. The resulting grade will be similar to the other properties in the <br /> neighborhood. To comply with the zoning code requirement, the height measurement and <br /> basement determination will be based on the pre-existing grade, not on the altered grade. <br /> - Re: Item 9. This standard requires that the fill and its resulting use for a new residence must not <br /> substantially impair the use and enjoyment of the property in the area or have a materially <br /> adverse impact on the property values in the area when compared to the impairment or impact <br /> of generally permitted uses. The proposed use of the property for construction of a residence <br /> will not be changing as a result of the proposed fill, so there should be no change in the use and <br /> enjoyment of adjacent properties. <br /> Re: Item 13. This standard requires that the fill be designed to take into account the natural, <br /> scenic, and historic features of the area and to minimize environmental impact. The fill and <br /> proposed grading on this lot will have minimal if any environmental impacts. The grading <br /> proposed is deemed by the applicant to be the minimum necessary to provide an ideal building <br /> pad for the proposed home. The septic sites have had to be tested to ensure the fill has had no <br /> negative impacts on those sites; applicant's site evaluator has confirmed that they continue to <br /> meet the City's criteria (Exhibit F). No �II or grading has been done nor is any proposed within <br /> the wetlands on the site. <br /> City Engineer Comments <br /> � City Engineer Jesse Struve reviewed the grading plan and had no comments other than a <br /> reminder that at the time when the future home is constructed 50-foot wetland bufFers will <br /> need to be established. <br /> Issues for Consideration <br /> 1. The applicant has paid the penalty fee for the after-the-fact nature of the CUP request <br /> (double application fee) and will be required to pay the double fee for the <br /> administrative zoning/land alteration permit if approved. <br /> 2.
