�4 . <br /> � � � Cit o� ORONO <br /> � } � <br /> RESOLUTION OF THE CITY COUNCIL <br /> ;.' 6 � N0. 2661 � <br /> a �� � � <br /> � <br /> C ) The house location is appropriate given the <br /> location of neighboring residences in relation to the <br /> lakeshore, hence the excess hardcover associated with <br /> the longer driveway is also appropriate. <br /> D ) The proposed new residence will remove a <br /> neighborhood eyesore, i.e. an old summer cabin which <br /> has not been used as a full-time residence for at least <br /> 10 years. <br /> E) Additional hardships include the fact that no <br /> additional land is available, and that construction of <br /> a residence nearer the road in order to meet hardcover <br /> standards would not allow applicant to enjoy lake views <br /> � afforded to adjacent properties. <br /> 4 . The City Council has considered this application <br /> including the findings and recommendations of the Planning � <br /> ; Commission, reports by City staff, comments by the applicant <br /> and the effect of the proposed variances on the health, <br /> safety and welfare of the community. <br /> 5. The City Council finds that the conditions existing on <br /> this property are peculiar to it and do not apply general ly <br /> to other property in this zoning district; that granting the <br /> variances would not adversely affect traffic conditions, <br /> light , air nor pose a fire hazard or other danger to <br /> neighboring property; would not merely serve as a <br /> convenience to the applicant, but is necessary to alleviate <br /> a demonstrable hardship or difficulty; is necessary to <br /> preserve a substantial property right of the applicant; and <br /> would be in keeping with the spirit and intent of the Zoning <br /> Code and Comprehensive Plan of the City. <br /> CONCLDSIONS, ORDER AND CONDITIONS <br /> Based upon one or more of the findings noted above, the <br /> Orono City Council hereby grants a variance to the Municipal <br /> Zoning Code Section 10.22, Subdivision 2 and Section 10.25, <br /> Subdivision 6 (B) to permit the constructior� of a residence on a <br /> � lot of 0.37 acres in area where 0.50 acres is normally required, <br /> and. of lot width 60 ' where - 100 ' in lot width is normal ly <br /> required, and comprising 34.26$ hardcover in the 75-250' setback <br /> zone where only 25� hardcover is normally allowed, subject to the <br /> f ollowing conditions: - <br /> Page 2 of 5 <br />
