Mabusth said all of the plumbing would be <br />removed and the septic tank would be abandoned as part of the new residence <br />construction and septic permit for new system. A new septic system will serve the new <br />residence. <br />Goetten moved, Jabbour seconded, to approve Resolution 93802. Vote: Ayes 4, Nays <br />0. <br />MAYOR/COUNCIL REPORT <br />Mayor Callahan, after indicating that he had reviewed the election canvassing report, <br />publicly congratulated those persons elected. <br />Goetten questioned what portion of CoRd 15 would be discussed at the next Council <br />meeting. Moorse indicated that both the east end and Bracketts Point would be <br />discussed. <br />Jabbour asked for a determination on whether the City can bank newly formed wetlands <br />for future mitigation. He noted that landscapers are selling such properties as a result of <br />its mitigation value. Mabusth said Staff has been following through on such a proposal <br />. and asked Cook to respond. <br />• <br />Cook said such banking of land for future mitigation was possible but difficult to set up. <br />He indicated that this will be accomplished as part of the comprehensive storm sewer <br />plan and will require adoption of a specific policy. <br />Mabusth noted that there is an issue of whether the City would have to pay for the land <br />and whether it would be set as a condition of the conditional use permit. Cook said he <br />would not expect the City to have to pay for the land. <br />Radio said the issue could be part of the application process and not a matter of having to <br />"take" anything. Radio said that the option legally and constitutionally is doable. <br />Jabbour indicated that people are selling the land because of the need for mitigation. <br />Kelley questioned what will happen if people create a pond and then decide at a later date <br />to fill it in. Cook indicated that a conservation easement would need to be placed on the <br />property to prevent this. <br />7 <br />
