MINUTES OF THE REGULAR ORONO CITY COUNCIL <br />MEETING HELD ON SEPTEMBER 9, 1996 <br />( 96 - 92160 David Dotzenroth - Continued) <br />Kelley was concerned with what would occur if the garage was found needing total <br />rebuilding. Jabbour said if walls have to be removed, the application would have to come <br />back before the Council. Gaffron said if the garage has to be rebuilt, the application <br />would come back before the Council. Kelley said he wanted the applicants to understand <br />and the building inspector aware of possible problems. Gaffron clarified that the garage <br />must be within the 1000 s.f size limitation, conditions #3 and 4 were eliminated. <br />Condition #5 requiring the completion of the house was to continue. Also, Finding #6 <br />was added noting the difference of opinion between the Council and Planning <br />Commission was due to the concern for the trees and need for additional concrete adding <br />to hardcover, and the similarity between garages in the neighborhood. Callahan <br />commented that the similarity issue would not be valid as improvements have to begin <br />somewhere. Jabbour asked why the push to finish the house was requested when no <br />neighbors have complained. Gaffron said the building permit allows for one year to finish <br />the exterior work on project. Goetten said the concern was beginning another project <br />when one was already begun. Dotzenroth noted a problem with a contractor setting the <br />remodeling back in time. <br />Vote: Ayes 3, Nays 1, Callahan. Motion carried. <br />C <br />( #7) #2161 JAMES AND MELISSA EASLEY, 4105 HIGHWOOD ROAD - <br />VARIANCES - RESOLUTION #3759 • <br />The applicants were present. <br />Gaffron reported that the property consists of a 40' wide lot, 8500 s.f in area, with an <br />existing house located mainly in the 0 -75' setback with a detached garage located near the <br />street and side lot line in poor condition. The parking area is gravel. A sidewalk and <br />retaining wall also exist on the property. <br />Gaffron informed the Council that it was the applicant's intention to tear down the garage <br />and build a new detached garage within T of the side lot line and 25 -30' from the street. <br />The doors would be located to the street side with parking in front. An enclosed <br />stairway is proposed for the 2 -story garage with a basement resulting in three levels. A <br />future concept of the attachment of the garage to a new house located out of the 0 -75' <br />setback was also noted. <br />is <br />
