� NOW'IT3EREFORE, for good and valuable consideration: <br /> 1. The Levangs hereby grant and convey to U.S, Banlc a perpetual non-exclusive <br /> easement for driveway, walkvc�ay, ingress, agess, and utility access piuposes over, under and <br /> across the above-described Easeznent Area. <br /> 2. The easement granted herein shall be penna.nent, shall run witli the land, and shall <br /> be an appurtenance to the U.S. Banlc Properry so as to benefit and burden the present and future <br /> ovv.�ers and encumbrancers of the U.S. Banlc Properly and the Levang Property. <br /> 3. U.S. Bank and its successors and assigns sha11 pay one-half of the costs of <br /> maintenance, repair, and snow removal incurred with respect to a11 of the Easement Area; it <br /> being understood that, fo��purposes of deterrnining the arnounts payable hereunder by U.S.Banlc, <br /> any amounts due and payable to the Levangs by the owners of Lofi 2, Block J, Popov Addit�on, <br /> for the use oF the Levang Property shall be deducted from the aggregate cosfs to be shared by the <br /> parties hereto prior to the calculation of the announts payable to the Levangs under the easement <br /> granted herein. <br /> 4. This Agreement shall no#be construed to disturb the rights and obligations of the <br /> owners of the owners of Lot 2, Block 1, Popov Addition, ar any otl�er parties in and to the <br /> Easement Area. <br /> S. This Agreement takes the place of and is in lieu of all prioz understandings and <br /> agreements between the Parties and their predecessors as #o the use and maintenance of the <br /> Easement Area, whethex such anderstandings and agrecments are oral or written. This <br /> Agraement constitutes the entire agreement of the Parties. No ather agreement not expressed <br /> within this Agreement shall have any force or effect, and no modi�cation, amendment or change <br /> of any kind to this Agreement shall be effective unless it is in writing and signed by each of the <br /> Parties to this Agreement. <br /> 6. All references in this Agresment to "I,evangs" and to "I7.S.
