Fisher Junior <br /> Address: 3300 Fox Street _ <br /> Orono, MN 55391 <br /> LOCATION OF VIOLATION: 3300 Fox Street <br /> DATE OF VIOLATION: August 14, 1990 <br /> VIOLATION OF ORONO MUNICIPAL CODE SECTION 10.22, SUBDIVISION 2, <br /> SECTION 10.55, SUBDIVISION 8 AND SECTION 10.03, SUBDIVISION 19 <br /> - The City became aware of this matter from Field Inspector <br /> Bruce Vang who was on the property next door and witnessed <br /> the violation. <br /> - Description of Violation: The defendant excavated within <br /> the protected 75' lake setback zone where no excavation is . <br /> allowed. Violation of Section 10.22 , Subdivision 2 - <br /> Excavating within the f lood plain. Violation of Section <br /> 10.55, Subdivision 8 - Excavating to alter existing grades <br /> within 75' of lake without a conditional use permit issued <br /> by the City Council . Violation of Section 10 . 03 , <br /> Subdivision 19 - The above was done after the defendant <br /> request to do the work but was told by Mike Gaffron, <br /> Assistant Planning & Zoning Administrator, that it was not <br /> allowed without a conditional use permit. <br /> - Photos have been taken. <br /> - The City' s objective is to fine the defendant. The <br /> defendant is working to restore the lakeshore yard and the <br /> City will not issue a Certificate of Occupancy for the new <br /> home until restoration is satisfactority completed. <br /> 1 <br />
