MINUTES OF THE <br />ORONO CITY COUNCIL MEETING <br />Monday, October 10, 2016 <br />7:00 o'clock p.m. <br />12. #16-3865 CITY OF ORONO TEXT AMENDMENT RELATED TO APPEALS AND <br />APPEAL TIMELINESS — ORDINANCE NO. 178 (continued) <br />Mattick indicated Staff can add that provision, which is if an appeal is not filed within ten days, a person <br />would lose their right to appeal. <br />Barnhart stated the appeals are based on a formal application and a formal written denial. For an issue <br />where Staff denies a permit, that is usually written into the denial document and the applicant is provided <br />that information. <br />McMillan asked if it is the same fee on every type of appeal. <br />Barnhart stated they are all established by the Council and that there is currently a $50 fee for <br />administrative appeals. Barnhart noted appeals of a zoning decision are more than that but that he does <br />not have that information in front of him tonight. <br />McMillan asked whether decisions of the board on appeals are binding. <br />Barnhart stated the applicant may appeal a decision of the board or Staff to the City Council, but that they <br />would need to file that appeal within ten days. <br />Printup moved, Walsh seconded, to adopt ORDINANCE NO. 178, Third Series, an Ordinance <br />Amending the City Ordinance Pertaining to Filing of Administrative, Zoning, and Subdivision <br />Appeals, with the clarification that if an appeal is not filed within ten days, a person would lose <br />their right to appeal. VOTE: Ayes 5, Nays 0. <br />MAYOR/COUNCEL REPORT <br />Walsh commented the Long Lake Fire Department event was a good time and that there was music, food, <br />and different activities for the kids. <br />Walsh stated the second item he would like to raise is a little more serious and that he would like to get a <br />consensus of the City Council. <br />Walsh stated it has come to his attention that an appointee of the Council, Gabriel Jabbour, who has been <br />at the podium a number of times and has constantly attacked him, has gone on a personal attack against <br />him by name calling to some --enior staff of Orono. Walsh stated if someone is an appointee of Orono, <br />that is a privilege and not a right and that they should be holding her or himself out as someone who is <br />representing the City. Walsh stated conduct unbecoming, such as that person calling him a criminal or <br />anybody else on this Council or other City Staff is inappropriate. <br />Walsh stated he would like included on the next Council agenda in October a discussion about the <br />removal of Gabriel Jabbour as Orono's LMCD representative based on conduct unbecoming of an <br />appointee of the City Council. <br />Page 21 of 26 <br />
