MEMORANDUM <br /> To: Lyle Oman, Ron Moorse, B&Z Department Staff <br /> From: Mike Gaffron, Planning Director <br /> Date: August 4, 2005 <br /> Subject: Temporary Property Viewing Stand—Vacant Lot 3Z�� f� O� <br /> In response to a realtor's request for construction of a temporary viewing stand to allow <br /> potential purchasers to see the views from the level of an upper story on a vacant <br /> residential lakeshore lot that is being marketed: <br /> City Attorney Tom Barrett has advised that City sanctioning of such a structure under the <br /> existing ordinances would put the "no accessory structure without a principal structure" <br /> ordinance at risk, and he advises against issuing a permit for such structure. Such a <br /> structure would be considered similar to a seasonal dock under the current ordinance. If <br /> the City wants to allow such "temporary viewing" or"marketing" structures, an <br /> ordinance amendment would be needed to make an exception for such structures, and a <br /> variety of conditions regarding their use, construction, longevity, etc. would have to be <br /> established. <br /> At this point I think we have no need to consider such an ordinance revision. The realtor <br /> should be advised that the City codes do not allow for such a structure, and that other <br /> methods for gaining such a view be employed, such as a mobile lift, or video-camera on <br /> an extendable tripod... <br />
