Upon the sale by Smith of the South Smith Parcel, the allocation of mauitenance <br /> costs and expenses shall be as follows: <br /> New proposed Lot 1 (North Smith Parcel): 55% <br /> Eacisting Lot 2, Block 1, Beau Marais (Casotti Pazcel): 30% <br /> New proposed Lot 2 (South Smith Parcel): 15% <br /> 4. If any one Lot Owner's share of the expenses for a maintenance project exceeds <br /> $500, that Lot Owner may require that the Lot Owners obtain competitive bids from not less <br /> than three unrelated contractors prior to commencement of work on the maintenance project. <br /> Upon receipt of all competitive bids, the contract for the ma.intenance project shall be given to <br /> the contractor with the lowest bid, unless otherwise decided by unanimous vote of all Lot <br /> Owners. <br /> 5. Each Lot Owner ("Indemnitor") shall indemnify and hold the other Lot Owners <br /> ("Indemnitees") harmless from and against any and all claims, actions, liability,_damages and <br /> expenses, including attorneys' fees and costs, in connection with the loss of life, bodily injury, <br /> and/or damage occurring on the driveway on an Indemnitee's parcel occasioned by Indemnitor, <br /> his agents, licensees or invitees, unless caused by the actions or omissions of the Indemnitees. <br /> 6.
