i Sec.13.04 RIGHTS OF SUB.TECTS OF DaT� Subd. 1. Type of data. "Ihe righ�s of individual on whom[he data is stored or co be scored shall be as set forth in this secaon. Subd.�. Information reqirired to be given individual. An individual asked to supply privare or confidenrial dara concerniag himself shall be informed of: (a)the purpose and intended use of the requesud dara within the collecting"state agency, polidcal subdivision,or sracewide system; (b)whe[her he may refuse oY is legal(y required to supply the requested data;(c)any lmown coasequence arising fmm lvs supplying or refusing to supply privace or confidendal data;and(d)the idenriry of other penoas or enrides authorized by state or federal law to receive the data. This requiremenc stiall not apply when an individual is asked to supply invesrigadve dara,pursuant co secdon 13.82, subdivision 5, to a law enforcement o�cer. The commissioner of revenue mav place the norice reauired under this subdivision in the individual income tax or properrv tax refund instiucvons instead of on those forms. Subd. 3. Access to data by individual. Upon reques[to a responsible authoriry,an individual shall be informed whether he is the subject of stored data on individuals,and whecher ic is class�ed as public, private or confidendal. Upon his further request, an individual who is the subjecc of stored private or public dara on individuals shall be shown the data without any charge to hicn and,"if he desires, shall be informed of rhe content and meaning of�hat data. Aftzr an individual has been shown the private data and informed of ics meaning,che data need not be disclosed to hirn for six months thereafter unless a dispute or acrion pursuant to this secrion is o�nding or addidonal data on the individual has been collected or creared. The responsible auchoriry shall provide copies of the private or public data upon request by the individual subject of the da[a. The responsible authoriry may require[he requesring person to pay the acnial cosrs of makine, certifying, and compiling the copies. The responsiblz authoriry shall comply immediately, if possible, with any request made pursuant to this subdivision,or within five days of the da[e of[he request,excluding Saturdays,Sundays and legal holidays,if immediate compliance is not possible. If he cannot comply with the reques[ within rhat time,he shall so inform the individual,and may have an addiaonal five days within which to comply with the request,excIuding Saturdays, Sundays and legal holidays. Subd.4. Procedure when data is not accurate or complete. An individual may contest the accuracy or completeness of public or pri��ate data conceming himself. To exercise this right,an individual shall noafy in wriang the responsible authoriry dzscribing[he nature of the disagreement. The responsibte authoriry shall within 30 days either: (a)correcc the data found to be inaccurate or incomplete and aaempc to nodfy past recipients of inaccurate or incomplete data, including recipients named by ehe individual; or(b)nodfy the individual that he believes rhe data to be correct. Data in dispute shall be disclosed only if the individual's statement of disagreement is included wi[h the disclosed data. The de[erminaaon of the rzsponsible authoriry may be appealed pursuant to the provisions of the administrzdve procedure act relaang [o contested cases. DATA PRIVACY ADVISORY In accordance with M.S. 13.04, Subd. 2, "Riahts of subjects of data", we would like to inform you that your reauest for a permi[ or license from the City of Orono or any of its departments may require you to fumish certain private or confidential information. You are notified that: 1. The information you furnish will be used to determine your qualification for the permit or license requested. 2. You may refuse to suppiy data, but refusal may require that the City deny the permit or license. 3. The information may be shared with ocher local, state or federal a;encies to the extent necessary to process the pernut or license. 4. If your requested permit or license requires Council action to approve, some information may become public. j.
