Municode Page 2 of 12 <br /> Construction means any action which in any way affects the physical components of any <br /> new or existing ISTS, including construction, installation, extension, alteration or repair, not to <br /> include pumping. <br /> Contractor means a person licensed under the provisions of Minnesota Rules chapter 7080 <br /> to engage in the business of site evaluation, system design, system construction and pumping. <br /> Disposal means the evaporation or absorption of purified liquids after treatment of the raw <br /> sewage. <br /> Existing system means any ISTS constructed and in use prior to the adoption of the <br /> ordinance from which this article is derived. "New systems" shall become "existing systems" at the <br /> time of final inspection and approval by the city. <br /> Failing system means any ISTS that discharges sewage to a seepage pit, cesspool, drywell <br /> or leaching pit. In addition, any ISTS posing an imminent threat to public health or safety as defined <br /> in Minnesota Rules chapter 7080 shall be considered failing. <br /> Inspection report means the official report of the results of the inspection by the city or <br /> private inspector, including any official orders to repair or replace a noncompliant or failing ISTS. <br /> Imminent threat to public health or safety("ITPH') means situations with the potential to <br /> immediately and adversely affect or threaten public health or safety. At a minimum, "ITPH" includes <br /> ground surface or surface water discharges and sewage backup into a dwelling or other <br /> establishment. <br /> ISTS means an individual sewage treatment system as defined in Minnesota Rules chapter <br /> 7080. <br /> Minnesota Rules chapter 7080 means the state pollution control agency standards for the <br /> design, construction, installation and maintenance of individual sewage treatment systems <br /> extracted from the current Minnesota Rules as adopted in this article. <br /> New system means any proposed ISTS, or any newly constructed ISTS which construction <br /> takes place after the adoption of the ordinance from which this article is derived until the time of <br /> final inspection and approval by the city. See Existing system. <br /> Noncompliant system means a prohibited ISTS; an ISTS located within a designated 100- <br /> year flood plain; any ISTS which may or may not meet all the location, design, or construction <br /> standards of this Code and which is failing for any reason; and any ISTS with less than three feet of <br /> unsaturated soil or sand between the distribution device and the limiting soil characteristics. <br /> Owner means any person having legal or equitable title or sufficient proprietary interest in <br /> any building or land subject to the provisions of this article. For purposes of notification, the owner <br /> shall be the occupant of the property or the person listed as taxpayer on the current tax rolls. <br /> Pollutants means bacterial or chemical impurities, including pathogenic bacteria, infectious <br /> viruses, toxic chemicals, excess nutrients (nitrogen and phosphorous), non-potable water, or <br /> septage. <br /> Privy means an outhouse, a cesspool enclosed by a building, typically not served with <br /> running water. <br /> https://1 ibrary.municode.com/print.aspx?h=&clientlD=13094&HTMRequesrhttps%3 a%2f%2flibrary.municode.com%2fHT... 6/24/2014 <br />
