RESTRICTIVE COVENANT <br /> FOR PROTECTION OF SEWAGE TREATMENT SITES <br /> KNOW ALL MEN BY THESE PRESENTS that E. Joseph LaFave, Trustee of the Helen <br /> Snyder Waldron Qualified Personal Residence Trust dated March 15, 2000 and Trustee under <br /> Article 4 of the William L. Waldron, Jr. Qualified Personal Residence Trust under Agreement <br /> dated March 15, 2000; Lucinda W. Charley and Michael Chorley, wife and husband; Stacey W. <br /> Eastman and Patrick Eastman, wife and husband; and Wendy W. Burton, a single person <br /> (hereinafter "Owners"), do hereby expressly covenant and agree to protect the two (2) approved <br /> sewage treatment sites depicted on the attached Exhibit A, located on the real property in the City <br /> of Orono, Hennepin County, Minnesota, legally described in the attached Exhibit B, per the <br /> following provisions: <br /> The property has two (2) Orono-approved sewage treatment sites each capable of serving a <br /> 5-bedroom residence. To protect these important sites from inadvertent damage or <br /> � destruction, Owners shall do the following: <br /> 1. Erect and maintain a clearly visible wooden-slatted snow fence at least 3 feet high <br /> during demolition and construction, to be twenty feet from the boundary of the <br /> approved primary and alternate sewage treatment sites along all parts of the <br /> property that are potentially accessible to vehicular traffic including cars, trucks, <br /> delivery vehicles, earth moving equipment, etc. Said fencing shall be in place prior <br /> to any demolition, earth-moving or construction activity on the site, and shall <br /> remain in place until completion of construction and final landscaping of the <br /> property. Said fencing shall have affixed to it a sign stating "Septic System Area - <br /> Keep Off'. <br /> 2. After completion of construction, Owners shall maintain the alternate (future) <br /> sewage treatment site in an undisturbed manner, and not allow any excavation, <br /> filling, structures or vehicular traffic on the alternate site, in order that the alternate <br /> site be available for future use should it be needed. <br /> This Restrictive Covenant shall run with the land, shall be binding upon Owners, their respective <br /> Lot 1 1 <br />
