L <br /> MINNEHAHA CREEK WATERSHED DISTRICT <br /> BOARD OF MANAGERS <br /> In the Matter of Olson Residential Property FINDINGS OF FACT <br /> 1860 Fox St., Orono CONCLUSIONS OF LAW <br /> AND ORDER <br /> FINDINGS OF FACT <br /> 1. On May 23, 2013, at a duly scheduled meeting of the Minnehaha Creek Watershed <br /> District (District) Board of Managers(Board), a hearing was held on the captioned matter. <br /> Managers present were James Calkins, Pamela Blixt, Richard Miller, Jeffrey Casale, Brian <br /> Shekleton, William Olson and Shei7•y Davis White. Also present were District compliance <br /> officer Brandon Wisner, District engineer Mike Panzer and assistant District counsel Michael <br /> Welch. Curt Swanson, Swanson Homes, in his capacity as contractor for the Olsons, also was <br /> present. <br /> 2. This matter concerns land-disturbing activity(site preparation, grading, landscaping and <br /> construction of a single-family residence) conducted at 1860 Fox St., Orono (the Property), <br /> without a District pei7nit. <br /> 3. The Board hearing was preceded by a meeting of the Board's Executive Committee <br /> (Managers Calkins, Miller and Shekleton), at which the probable violation and possible terms of <br /> a Board compliance order were discussed. Mr. Wisner, Mr. Panzer and Mr. Welch were present <br /> at the meeting, as were Michael Olson, on behalf of himself and his wife,Jennifer Olson, owners <br /> of the above-captioned property (the Olsons), and Mr. Swanson. <br /> 4. At the hearing, Mr. Wisner introduced the following documents into the record,which <br /> constitute the hearing record in this matter: <br /> A.
