� , � �s747� <br /> : , <br /> ���0 CITY OF ORONO <br /> RESOLUTION OF THE CITY COUNCIL <br /> ��. �, No. 6 6 5 � <br /> tqk£S H�R� <br /> A RESOLUTION <br /> APPROVING VARIANCES FROM <br /> MUNICIPAL ZONING CODE <br /> SECTIONS 78-305; 78-1279; 78-1680; and 78-1700 <br /> FILE NO. 16-3839 <br /> WHEREAS, Sharon Olson-Nesbitt, a single person (hereinafter the "ApplicanY'), is <br /> the owner of the property located at 865 Ferndale Road West and legally described as: <br /> Lot 104, Auditor's Subdivision No. 184, Hennepin County, Minnesota (hereinafter the <br /> "Property"); <br /> WHEREAS,on May 18, 2016,the Applicant has made application for a variance from <br /> Orono Municipal Code Section 78-305 to permit construction of a garage addition encroaching as <br /> close as 10.2 feet to the side lot line where a 30-foot setback is normally required; and <br /> WHEREAS, the Applicant has made application to the City of Orono for a variance <br /> to Orono Municipal Zoning Code Section 78-1279 to allow construction of a garage addition 71 <br /> feet from the ordinary high water level from Lake Minnetonka (hereinafter the "OHWL") where a <br /> 75-foot setback is normally required; and <br /> WHEREAS, the Applicant has made application to the City of Orono for variances <br /> to Orono Municipal Zoning Code Sections 78-1680 and 78-1700 to permit 34.6% total site <br /> hardcover where 34.7% currently exists and a 25% limit is normally required; and 14.8% <br /> hardcover within the 0-75-foot zone where 16.6% currently exists and 0% is permitted, in <br /> conjunction with construction of a garage addition and reconstruction of the driveway; and <br /> WHEREAS, on July 18, 2016, after published and mailed notice in accordance with <br /> Minnesota Statutes and the City Code, the Orono Planning Commission held a public hearing, at <br /> which time all persons desiring to be heard concerning this application were given the opportunity <br /> to speak thereon; and <br /> WHEREAS, on July 18, 2016, the Planning Commission recommended approval <br /> of the variances; and <br /> WHEREAS, on August 8, 2016, the City Council reviewed the application and the <br /> recommendations of the Planning Commission and City staff; and <br /> l <br />
