MINUTES OF THE REGULAR ORONO CITY COUNCIL <br />MEETING HELD ON OCTOBER 13,1997 <br />( #9 - #2295 Conley Brooks Jr. - Continued) <br />Regarding the fence, Brooks said he is attempting to preserve the natural look of the <br />roadway. He would like to place the fence back behind the tree line to prevent <br />trespassing and view of the narrow property. Brooks is also concerned with problems <br />with snowmobilers. He feels the fence will blend in and discourage trespassing. As far <br />as the 10' placement from the road, Brooks thought the average distance would be about <br />13 -15' with the closest distance at about 12'. He said the request could be amended to <br />state a 12' distance instead of 10'. <br />During public comments, Robert Floyd, 960 Ferndale, reported living next door to the <br />Brooks property with his dock on the south side of the road. He asked for a point of <br />clarification regarding whether the approval would be contingent on the final subdivision <br />approval of the Skarp property. Gaffron said he believed it would be affected by that <br />outcome. Barrett indicated the fence would be related but the garage would not be as <br />there is no ownership contention regarding that property and legal combination can <br />occur. There would be two resolutions. Barrett said the parcels affected regarding the <br />garage are north of the roadway consisting of parcels H, E, and A. <br />Floyd said he is in favor of both the garage and fence. He is concerned with the timing <br />and relationship with regards to the Skarp property. He said he believed it would be <br />difficult to locate a fence elsewhere, there are other buildings near the road along <br />Ferndale, and the existing garage is in poor condition. As to the fence, he noted <br />trespassing and parking problems and would be consistent with other hedges and fences <br />in the area. Floyd thought the fence request was reasonable and would be an asset to the <br />area. He would like to see approval contingent on the determination regarding the <br />relationship of his property to the Skarp property. <br />Bob Mitchell displayed several maps dating back to the late 1800's showing the location <br />of Ferndale Road. He said the applicant is attempting to improve the property. He noted <br />the wide right -of -way was platted in 1902 but has never been used to that width. <br />Mitchell said the applicant would remove the fence if found to be necessary and would <br />agree to a hold harmless agreement. <br />Jabbour said he was not in favor of a fence located in the lakeshore preferring open <br />space but understands the argument for some properties to need such a fence. He <br />believes these rationales do not exist regarding this property as the marsh is located <br />behind it. He believes there is a strong distinction between this property and other <br />properties. <br />Jabbour said the fence would not impact visually, and he would like to see a buffer. He <br />supported the fence request. <br />
