MINUTES OF THE REGULAR ORONO CITY COUNCIL <br />MEETING HELD ON OCTOBER 13,1997 <br />( #7 - #2288 Jason Theis - Continued) <br />Council and Staff discussed what setback area the recommendation for hardcover <br />variance under #1 referred to. It was determined that the first 40' of the lot was in the <br />75 -250' setback and the remainder in the 250 -500' setback. The applicant may not need <br />the side setback as requested. <br />Theis noted that the property slopes to the rear which allows drainage to flow away from <br />the lake. <br />Jabbour informed Theis that the Council was in favor of the application but wanted to <br />ensure the language in the resolution was correct and other issues are resolved. The <br />applicant will need to work with Staff to verify hardcover calculations on an accurate <br />survey. Theis said he would like to begin construction this fall. <br />Jabbour moved, Goetten seconded, to direct Staff to bring a revised resolution with <br />appropriate language and corrections to the Council for approval. Vote: Ayes 5, Nays 0. <br />( #9) #2295 CONLEY BROOKS, JR., 980 WEST FERNDALE ROAD - <br />VARIANCE - RESOLUTIONS NO. 3977 AND 3978 <br />Conley Brooks, Jr., and Attorney, Bob Mitchell, were present. <br />Gaffron reported the application is a two -part request. One is for street and wetland <br />setback variances for construction of a garage to replace an existing garage in poor <br />condition located in Parcel H. The garage construction also requires a variance for an <br />accessory structure located nearer to the street line than the house. The second part of <br />the application is for variances and permit for reconstruction of a fence within the right - <br />of -way and less than 75' from lake located between the paved road and the property line. <br />Staff recommends if garage is approved, the lots be legally combined. Gaffron noted <br />there is court action pending regarding ownership of 20' lakeshore parcel at the east end <br />of Parcel F. <br />Gaffron said the existing garage is located 2.8' within the right -of -way and new garage <br />proposed F from the lot line. It would meet the 10' side setback and 20' from the <br />wetland, where 26' separation is required. The Planning Commission reviewed the <br />proposed garage and voted 6:1 for approval of a street setback variance with location <br />closer to street than house. They recommended the garage to be within a 18x24' <br />7 <br />
