MINUTES OF THE REGULAR ORONO CITY COUNCIL <br />MEETING HELD ON SEPTEMBER 8.1997 <br />( #5 - #2270 Marcia and Kenneth Hickey - Continued) <br />Goetten said she could not support the height requested. She suggested a lower height <br />be maintained and shed could remain. She questioned whether the shed could be moved. <br />Van Zomeren informed Goetten that the shed was not located in the right -of -way as was <br />thought by Goetten but was in front of the principal structure with a possible sideyard <br />encroachment. <br />Hickey said he would prefer the height as requested. He indicated the shed is built on a <br />slab that has been there since 1952. The shed was recently rebuilt. <br />Flint said he felt there were other areas on the property that would allow the applicant's <br />needs for storage to be achieved. He does not favor the location in front of the principal <br />structure noting it would be obtrusive. He also felt it would be unsatisfactory to other <br />residents. <br />Hickey questioned whether Flint has viewed the property. Flint said he had not but was <br />familiar with the area. Hickey said there was foliage surrounding the area resulting in a <br />garage that would not be obtrusive. He noted both of his neighbors have two levels. <br />Jabbour said Hickey should not have to be at the mercy of the neighbors. He said he <br />views the application itself and its demonstration of hardship. He again inquired what the <br />• hardship is for the height. <br />Barrett was asked by Jabbour whether the views of the neighbors have a bearing on what <br />is approved. Barrett said the opinion of the neighbors is not enough to defeat what is <br />otherwise an acceptable application. <br />• <br />Jabbour asked the applicant how he would like to proceed explaining the procedures and <br />time limitations. <br />Flint asked why the garage could not be built on the south side. Hickey said a cliff is <br />located in that area. While there is no height problem there, he is unable to access it. <br />Hickey noted the lot is long and narrow limiting where a garage can be located. The <br />north side would have the same problem. An easterly location would result in access <br />during the winter months with having to travel upgrade. <br />Jabbour said the applicant has demonstrated the hardship regarding location. <br />Jabbour asked the applicant if he would like the Council to vote on approval of the <br />garage in the proposed location but without a height variance or state the hardship for the <br />height.
