WHERCAS, simulfaneously lierewith Longridge is conveying to Craigbank that portion <br /> of Parcel A legally described as follows: <br /> The South 305 feet of ti�e West 500 feet of Outlot A, MACMILLAN ADDITION, <br /> Hennepin County, Mim�esota(Torrens)(herein"Parcel A-South"}; and <br /> WHE1t�AS,tl�e South Parccl as above described is corapcised of Parcel A-South and <br /> Parcel B; <br /> WHER�AS, notwithstandir►g the above it is the intent of Owners and tl�e City that a � <br /> Parcel A-South and Parcel B are and shall hencefortli be conlinued in commou ownership by the <br /> same person or persons, and fiarlher that Parcel A-South and Parcel B are intended to be used <br /> and/or developed in conu»on by Craigbank as they were in fact one parcel instead of two. <br /> NOW,THEREFORE, for and ia�consideration of tl�e sum of One Dollar($1.00}and <br /> other valuable consideration, Owners hereby covenant, grant, gift,quit claim and convey io the <br /> City the right to restrict, a��d Owners hereby agree to restrict, limit and preclude the ownership, <br /> use,improvement and development o£the South Parcel according to a��d under ihe conditions <br /> and covenants herein contained, as follorvs: <br /> 1. The City shall not issue any building pennits, zoning variances or conditional use <br /> permits for any structure or use u�the South Parcel inconsistent with the covenants contained <br /> herein. <br /> 4. Owners hereby grant to the City the right to enter upon the Soutk�Parccl for the <br /> purposes of inspection and enforcement of the covena�ris contained herein, and to cause to be <br /> lawfully removed from the Soutl�Parcel, without any liability, any structures, uses, substances <br /> and natural or unr►atural materials inconsistent witta the covenants contained herein. <br /> 5. In addition to any other remedy tiie City may have, the covenants and restrictions <br /> contained herein inay be enforced by injuuction. Any owner who is in possession of the Soutli <br /> Parcel,including,witl�out limitation, Craigbanlc, its successvrs and assigns, shali pay to the City <br /> all costs and expenses including reasonable attorneys' fees incuned by the City in enforcing the <br /> terens of this indenture. <br /> 6.
