The City Council finds that granting a conditional use <br /> permit to allow the continued use of the second residential <br /> structure on the property for guest house use wi 11 not be <br /> detrimental to the health, safety. or general welfare of the <br /> public, would not adversely affect light, air nor pose a <br /> fire hazard or other danger to neighboring properties, nor <br /> will it depreciate surrounding property values and that the <br /> proposed level of use of the property will be in keeping <br /> with the intent and objectives of the Zoning Code and <br /> Comprehensive Plan of the City. <br /> 5. The City Council has considered this application including <br /> the findings and recommendations of the Planning Commission, <br /> reports by staff and comments of the applicant and the <br /> affect of the proposed use on the health, safety, and <br /> welfare of the community. <br /> CONCLIISIONS, ORDER AND CONDITIONS <br /> Based upon one or more of the above findings, the Orono City <br /> Council hereby grants a Conditional Use Permit per Municipal Zoning <br /> Code Section 10.28 , Subdivision 3 (A) to permit a guest house use at <br /> the property subject to the following conditions: <br /> 1 . Applicant and future owners are placed on notice that the <br /> guest house structure has been classified as a non- <br /> conforming structure based on its substandard setback from <br /> the side lot line at 10' and from the adjacent Tananger Bay <br /> lakeshore at approximately 70'. Any major structural repair <br /> of this structure or expansion of this structure will <br /> require variance approval of the City of Orono. <br /> 2. The guest house is for the exclusive use of applicant, <br /> applicant' s guests or hired help and may never be used for <br /> rental purposes . <br /> 3 . Applicant has been allowed thirty days from the date of this <br /> approval (deadline, October 14, 1992) to obtain confirmation <br /> from a licensed on-site evaluator as to the conformity of <br /> the on-site septic system that serves the existing guest <br /> house. If the system is found to be non-conforming, a new <br /> septic system must be installed within one year (October 14, <br /> 1993 ) . <br /> Page 2 of 5 <br />
