Kluth stated he will comply <br />with whatever restrictions the City Council deems necessary. <br />Kelley remarked the City Council cannot act on this application until the ordinance amendment is <br />approved. <br />Kluth stated the pipes have been run to the outside of the building but are not connected to any <br />fixture. <br />Goetten inquired when the amendment can be ready for review. <br />Gaffron stated the amendment will be ready for review by the next meeting. <br />Mayor Jabbour stated the City Council cannot approve a conditional use permit for something <br />that does not currently exist in the City Codes. <br />Flint stated he is in favor of waiting until the amendment is approved. <br />Jabbour moved, no second, to approve Application 42389, granting of a <br />Conditional Use Permit contingent upon approval of the Zoning Code Amendment • <br />Regulating Plumbing in Accessory Structures. <br />Kluth stated he does not need approval for the guest house but merely the plumbing fixtures. <br />Mayor Jabbour withdrew his motion. <br />Weinberger stated the deadline for this application is October 15th. <br />Kluth stated he will request another extension if necessary. <br />Jabbour moved, Peterson seconded, to table Application #2389, 2801 Fox Street, <br />to the next City Council meeting. VOTE: Ayes 5, Nays 0. <br />( #15) APPEAL OF ADMINISTRATIVE DECISION - ROAD ACCESS, 3410 NORTH <br />SHORE DRIVE <br />Gaffron'stated Mr. Regan has applied for a building permit to make improvements to his property. <br />The proposed work meets all setback and hardcover requirements; however, issuance of that <br />building permit has been delayed based on Mr. Regan's proposal to construct a second driveway <br />access off of Tonka%va Road using Jim Render's private road. <br />Gaffron stated when the subdivision for Render was reviewed by City Council, Staff was unaware • <br />that Regan's old garage was being accessed via Render's driveway because access to the North <br />Page 12 <br />
