The proposed use of the accessory structure as a pool house will not be <br /> detrimental to the residential character of the neighborhood. <br /> c. The Property exceeds the 2.0 acre minimum lot area requirement. <br /> d. The accessory building in which the plumbing will be located is <br /> confonning in location, size and height. <br /> e. The applicants have agreed, as part of this resoiutioi�, to enier into a <br /> covenant that disallows use of the accessory buildin� for a home <br /> occupation, dwelling, or rental/lease of the buildii�g as a dwellina. <br /> 4. The City Council has considered this application including the findings <br /> and recommendation of the Planning Commission, reports by City staff, <br /> comments by the applicants and the public, and the effect of the proposed <br /> conditional use peimit on the health, safety and welfare of the community. <br /> 5. The City Council finds that the conditions existin� on this Property are <br /> peculiar to it and do not apply generally to other property in this zoning <br /> district; that granting the conditional use pemlit would not adversely affect <br /> traffic conditions, li�ht, air nor pose a fire hazard or other danger to <br /> �Zeighborin; property�; ivct.ld not merely serve as a convenience to the <br /> applicants, but is necessary to alleviate a demonstrable hardship or <br /> difficulty; is necessary to preseiti�e a substantial property right of the <br /> applicants; and would be in keeping with the spirit and intent of the <br /> Zoning Code and Comprehensive Plan of the City. <br /> CONCLYJSIO�S, ORI)E�2 AND CONDiTIO'.�15 <br /> Based upon one or more of the above findings, the Orono City Council hereby <br /> grants a conditional use pern�it per Oro�io Municipal Zoning Code Section 78-418 (16) to <br /> allo�� installation of plumbin�, consistinV of a toilet, tub or shower and sir�, in an <br /> accessory building located on the Property, sub;ect te rhe iollowina cc�nditions: <br /> l.
