The Owner's proposal is consistent with the comprehensive plan. <br /> m. The Owner has requested a 26.5 foot setback from Fox Street; a 16.2 <br /> foot setback from Barrett Avenue; and a 28.4 foot setback from the <br /> undeveloped alley right-of-way on the east. Barrett Avenue, the alley, <br /> and the east portion of Fox Street are currently undeveloped. The <br /> Owner is requesting to build a home closer to the rights-of-way than <br /> 50-feet as allowed by the City Code. The Owner understands and is <br /> hereby put on notice that the City does not intend to vacate the <br /> abutting undeveloped rights-of-way and although not planned at this <br /> time, may choose to develop them for some public purpose in the <br /> future. <br /> 4. The City Council has considered this application including the findings and <br /> recommendations of the Planning Commission, reports by City staff, <br /> comments by the Appticant and the public, and the effect of the proposed <br /> variances on the health, safety and welfare of the community as well as the <br /> impact on properties in the vicinity. <br /> 5. The City Council finds that the conditions existing on this Property are peculiar <br /> to it and do not apply generally to other property in this zoning district; that <br /> granting the variance would not adversely affect traffic conditions, light, air nor <br /> pose a fire hazard or other danger to neighboring property; would not merely <br /> serve as a convenience to the Owner, but is necessary to alleviate a practical <br /> difficulty; is necessary to preserve a substantial property right of the Owner; <br /> and would be in keeping with the spirit and intent of the Zoning Code and <br /> Comprehensive Plan of the City. <br /> CONCLUSIONS, ORDER AND CONDITIONS <br /> Based upon the above findings, the Orono City Council hereby grants variances from Orono <br /> City Code Section 78-420 in order to construct a new residence on the Property with 19,234 <br /> square feet or 0.44 acre in area, and 129 feet in width where 2.0 acres in area and 200 feet <br /> in width are required; and variances from Orono City Code Section 78-420 to permit <br /> construction of a new residence 26.5 feet from Fox Street; 16.2 feet from Barrett Avenue; <br /> and 28.4 feet from the undeveloped alley on the east side where a 50-foot setback is <br /> required; subject to the conditions listed below: <br /> 1. Council approval is based on ths survey and building plans submitted by the <br /> Applicant and annotated by City staff, attached to this Resolution as Exhibits A 8� B. <br /> Any amendments to these plans may require further Planning Commission and City <br /> Page 3 of 5 <br />
