Barrett Avenue Vacation Inquiry <br /> November 30,2011 <br /> Page 2 <br /> 10) The property directly northeast (and across the non-vacated alley) from the single lot <br /> behind 1340 is owned in common with the residence property at 565 Hanlon Avenue and <br /> contains a portion of the driveway for that property. <br /> 11) The property directly east (and across Hanlon Avenue) from the single lot behind 1340 is <br /> owned as part of the 1300 Shoreline Drive residence property. <br /> 12) Barrett Avenue as it exists between 1340 and 1380 is a 60-foot wide corridor that has <br /> some potential for future public use for utility and access purposes, despite the steep <br /> topography. <br /> 13) The property at 1340 has made use of the Barrett Avenue right-of way for access and has <br /> maintained a garage structure at that location since at least l 955 (based on City airphotos) <br /> and potentially many years prior to that While that garage is non-conforming, it is <br /> unknown whether that garage would be considered as legally nonconforming. That <br /> garage location is within the west half of Barrett Avenue. If Barrett Avenue was vacated, <br /> there would be an issue as to future ownership of the garage as the vacation process <br /> would likely assign the west half of Barrett Avenue to 1380 and the east half to 1340. <br /> 14) The single lot behind 1340 was considered as part of 1380 when sewer assessments were <br /> adopted in 1980, and at that time the lot was not provided with a sewer stub, was not <br /> assessed for sewer, and was not considered as individually buildable. The City has no <br /> obligation and no intent to provide a sewer connection for this lot. <br /> 15) Extension of a driveway within the Barrett Avenue right-of-way from the north to access <br /> the single lot behind 1340 would require City approval. No driveway connection to the <br /> property at 1380 would be allowed since that would constitute a second driveway, <br /> inconsistent with City codes that allow only one driveway access per property. <br /> Based on the above, staff will not support an application for vacation of Barrett Avenue. <br />
