Blocks 2 and 3 exceed the 5 acre requirement. Septic system sites have <br />been approved on all lots. The existing house has a septic system that needs to be replaced by the <br />year 2007. Hennepin County has agreed to build an access to Block 3 off of Turnham Road. The <br />County will also build a new driveway for Block 2 from McCulley Road with City approval. The <br />existing house will continue to use the existing access. Park dedication fees will be required for <br />Blocks 2 and 3. The Watershed District may require some ponding or an alternative method to deal <br />with stormwater such as buffer strips. The applicant confirmed that she has not yet made an <br />application to the Watershed District. Issues to be resolved include: <br />confirm the dry buildable acreage for Block 1, and determine if a variance could be <br />granted if the dry buildable is less than 5 acres because of the uniqueness of the lot. <br />review by Kellogg of the vegetative buffer proposal indicating that the rate of runoff <br />will not increase and nutrient removal will be sufficient. <br />Kellogg noted that the current plan needs to be clarified as to nutrient removal. The size of the lots <br />and homes proposed do not substantially increase runoff flows. The proposal will limit off -site <br />• runoff to pre - development conditions but does not address sediment and nutrient removal, which <br />a pond would do. The Watershed District would require a variance if a pond was not installed. <br />Kellogg expressed concern that the vegetative buffer strips may not be wide enough in some areas <br />and would be more effective if enlarged. <br />The applicant commented that Blocks 2 and 3 have no proposed development. The subdivision is <br />being done to separate the lots for tax purposes within the family. <br />Kelley commented that the hardship has not been created by the applicant but by the City and <br />County. He felt the runoff on this property would be caused by the roads rather than the house. <br />Anything the City can do to help the applicant with hardcover and runoff issues should be done. He <br />questioned if the County had taken appropriate measures for their runoff. Jabbour responded that <br />the County had to abide by the same rules as other agencies regarding runoff. Gaffron added that <br />in the approval process, the Watershed District took into account that the road was linear and it didn't <br />make sense to create ponds for the additional 6 -8' of road width. <br />Goetten asked if the applicant needed to apply to the Watershed District at this time. Jabbour <br />responded that the subdivision triggered the Watershed District's involvement. It would also be best <br />to complete the subdivision while the current Council was familiar with the circumstances. <br />Kelley moved, Flint seconded, to approve Resolution No. 4094 granting preliminary plat approval <br />for the property located at 4490 Watertown Road.
