MINUTES OF THE <br />ORONO CITY COUNCIL MEETING <br />Monday, September 12, 2016 <br />7:00 o'clock p.m. <br />10. #16-3847 CHARLES CURD, LLC, ON BEHALF OF DDK, LLC, 2525, 2535, AND 2545 <br />SHADYWOOD ROAD, PRELIMINARY PLAT AND REZONING — RESOLUTION NO. 6668 <br />(continued) <br />McMillan asked whether any large trees will be planted in that area. <br />Barnhart stated the plan would show the trail and any landscaping. <br />Walsh stated anyone can plant stuff within the right-of-way but that there is a potential risk it might need <br />to be removed at some point. <br />Barnhart indicated Staff would use similar type of language in the resolution that was used in the Eisinger <br />resolution. <br />McMillan noted Hennepin County is looking at possibly redoing the 19115 intersection sometime in 2020. <br />Hennepin County is looking at realigning the intersection and possibly adding some improvements, such <br />as a trail. <br />Barnhart stated the direction he has heard is to provide the easement within the development. <br />Walsh noted the developer also wanted some flexibility on the FAR. Walsh stated if everything is <br />factored in, such as the outlot square footage and road square footage, it would not be over the 0.5, and so <br />he is willing to give them some flexibility on that. <br />Levang and Printup indicated they are fine with that. <br />McMillan asked whether there is enough landscaping being proposed to protect those homes if the <br />buckthorn is removed. <br />Barnhart stated Staff can ensure that the landscaping plan reflects that if the buckthorn is removed. <br />McMillan noted she has not seen a landscaping plan and that this is a sensitive area. McMillan noted the <br />wetland buffer should not be disturbed even though there is buckthorn in there. <br />Walsh stated his recollection is that the residents were fine with leaving the buckthorn since it provides a <br />lot of screening. Walsh stated from his perspective, the neighbors' desires outweigh the need to get rid of <br />the buckthorn. <br />Levang noted the revised plan preserves 14 more trees and that the developer has been sensitive to the <br />desires of the residents. <br />Council Member Printup stated he would caution against leaving the buckthorn in this development since <br />the City would be opening itself up to having to allow buckthorn to remain on other properties. <br />Levang noted this is an RPUD and the City is allowed some flexibility. <br />John Stein, Charles Cudd Company, commented that there is currently a preserved buckthorn area in <br />Creekside that was done years ago. <br />Page 4 of 34 <br />
