MINUTES OF THE REGULAR ORONO CITY COUNCIL <br />MEETING HELD ON JANUARY 26, 1998 <br />( #9 - #2319 Ron Lauer - Continued) . <br />Flint said he initially was not in favor of the proposed plan, but after hearing the <br />discussion, he is undecided. <br />Peterson cited a recent application where a building pad for the home was turned to <br />accommodate the average lakeshore setback. In viewing this application as new <br />construction and yet agreeing with the need for the large home size, Peterson said she <br />finds it difficult to approve the variance. <br />Goetten said she initially questioned the variance but has gained a better understanding of <br />the grading changes and problems arising from moving the house back on the lot. She <br />feels the hardship is the hill. If the concern is the hardcover, she suggested that the <br />resolution stipulate no additional hardcover will be allowed in the future. Goetten noted <br />that there is no hardcover proposed in the 0 -75' setback and supports the application. <br />Kelley said he supported the application. He did suggest the possibility of reducing the <br />garage to two stalls and building another garage on the hill. <br />Jabbour reiterated his concern with sending mixed messages. He noted the concern with <br />building massiveness by the lakeshore would not be present in this case. He questions the <br />benefit of meeting the requirements with no variance due to the circumstances with the <br />hill. Jabbour feels the large amount of land can be reallocated into another zone. He . <br />supported the application. Jabbour noted he had not met the applicants prior to this <br />meeting. <br />Goetten moved, Jabbour seconded, to approve Resolution No. 4024 with the new <br />rendering of the driveway portion out of the 75 -250' setback for a 29.87% hardcover in <br />the 75 -250' setback. Additional hardcover is to be reallocated and reduce the amount <br />allowed in the 250 -500' setback. <br />Gaffron reviewed the findings in favor of the application: hill, loss of trees, view, <br />driveway, existing building pad, reallocation of hardcover being reused due to <br />narrowness of lot. Gaffron said more findings from the discussion can be added. He <br />asked if the application should be seen by Council again. Goetten and Jabbour agreed to <br />add the findings to the motion without further review by Council. Kelley asked that the <br />findings include the neighbor to the north's concern regarding runoff. He assumed a <br />grading plan will be required. Gaffron said a condition can be placed requiring the <br />drainage and grading plan be submitted prior to issuance of building permit. This <br />condition was added to the motion. <br />Vote: Ayes 4, Nays 1, Peterson. <br />(A short recess was held.) <br />12 <br />
