This is a <br /> plat-dedicated right-of-way and as such serves the neighborhood as access to the lakeshore. There is a <br /> substantial record of neighborhood residents historically enjoying the use of this right-of-way for access <br /> to the lake for swimming, boating,snowmobiling, etc.which has been severely curtailed since the house <br /> at 4415 Forest Lake Landing was constructed in the 1990s. <br /> The City has not taken action to have landscaping elements removed from the right-of-way, although <br /> those elements are at risk should the City at some future date determine their removal is necessary. The <br /> City does have the right to require removal of these encroachments.The property enjoys the right to <br /> driveway access, and the current driveway configuration has been in place since the house was built. <br /> While we have no plans to improve the right-of-way at this time,there have been past discussions <br /> regarding making the access more user-friendly for the public. The City may clearly mark the boundaries <br /> of the existing right-of-way. <br /> 2) Aerial photo and site plan evidence in City files suggests that the dock serving the property is partially <br /> within the extended City right-of-way. Lake Minnetonka Conservation District(LMCD)regulations require <br /> that docks meet specified set backs from extended lot lines. We will require the existing dock to be <br /> relocated to meet LMCD regulations. <br /> Please feel free to contact me if you have any questions regarding the City right-of-way or the dock.
