Sec.13.04 RIGHTS OF SUBJECTS OF DATA Subd. 1. Type of data. The rights of individual on whom the data is stored or to be s[ored shall be as set forth in this section. 5ubd.2. Information required to be given individual.An individual asked ro supply private or confidential data concerning himself shall be informed of: (a)the purpose and intended use of the reques[ed data within the cellectin;state a;ency,political subdivision,or statewide system;(b) �vhether he may refuse or is le�aity required to supply the requested data;(c)any known consequence arising from his supplying or refusing to supply private or confidential data;and(d)the identiry of other p^rsons or entities authorized by state or federal law to receive the data. Subd.3. Access to data by individuxl. Upon request to a responsible authority,an individttal shafl be informed whether he is the subject of stored data on individuals,.and whe�her it is classified as public,private o,-confidential. Upon his fui-[her request,an individual who is the subject o: stored private or public data on individuals shall be sho�vn the data�vithout any charge ro him and,if he desires,shall be informed of che contenc and meaning of[hat data. After an individua]has been shown the pnvate data and informed of its meaning,the data nezd not be disclosed to him for six months thereafrer unless a dispute or action pursuant to[his sec[ion is pending or additional data on the individual has been collected or created. The responsible au.hority shall providz copies of the pnvate or pu6(ic data upon request by the individua!subjec[of[he daca. The responsible auchority may require the requesting person to pay[he actual costs ofmaking,certifying,and compiling the copies. The responsible autt;ority shail comply immediately,ifpossible,wi.h any request made pursuant to this subdivision,or within five days oF the dace of the request,e�cluding Sa[urdays,5undays and legal holidays,if irctmediate compliance is not possible. If he cannot comply with che request within that time,he sha11 so inform�he individual,and may have an additional five days�vid�in which to co;nply with che request,excluding Saturdays, Sundays and legal holidays. Subd.4. Procedure when data is not accurate or complete. An individual may contest the accuracy or comple[eness ofpublic or private data conceming himself. To exercise this right,an individual shatl no:ify in wiiting the responsibiz authority descnbino the na[ure of the disagreement.The responsible authority shall within 30 days either: (a)con ect the data found to be inaccura[e o;incomplete and attempt to notify pasc recipients o:` inaccurate or incomplete data,including recipients named by[he individual;or(b)notify the individual that he believes the data to be correct. Dat2 m dispute shall be disclosed only if the individual's statement of disagreement is included wi[h the disclosed data. The determinauon of the responsible zuthority may be appealed pursuanc to the provisions of the administra!ive procedure zct rela!ing to contested cases.
