MINUTES OF THE <br /> ORONO PLANNING COMMISSION MEETING <br /> Monday,August 20,2012 <br /> 6:30 o'clock p.m. <br /> particular zone and whether they should be lumped together into the same tier. The City Council also <br /> discussed the DNR regulations. <br /> Gaffron stated the DNR regulations do not limit the location of hardcover and that it is merely a <br /> percentage of the entire lot. <br /> Landgraver stated there was also a concern with including the 0-75 foot area and that there was not a <br /> consensus of the City Council regarding the area beyond the 250-foot zone. Landgraver stated Staff was <br /> a little bit frustrated because the Council could not decide definitely yes or no on whether the City should <br /> go with the tier system. The City Council ended up with requesting Staff to do an analysis of some <br /> sample properties under various scenarios. <br /> Gaf&on noted the ordinance was tabled for a month and will be before the City Council on <br /> September 10`h. Ben Gozola will not able to be in attendance at that meeting but will be providing some <br /> information on the criteria for how the properties were determined to be in which tier. <br /> Levang stated the Council also discussed retaining walls and the requirement that the City Engineer <br /> determines whether it is necessary for drainage or for aesthetic purposes. The City Engineer indicated he <br /> would prefer that retaining walls would either be considered hardcover or not considered hardcover. <br /> Landgraver stated there were also a couple of people in attendance who served on the task force who had <br /> expressed some frustrations with the process. <br /> Landgraver noted the City Council did approve the application on Pheasant Road. <br /> Gaffron commented the variance was out of character. <br /> Landgraver stated there should be some feedback to the Planning Commission that lets them know what <br /> the hardship is when they approve an application over the recommendation of the Planning Commission. <br /> City Council Member Bremer stated in her view the Planning Commission made the right <br /> recommendation. <br /> Gaffron stated the fact that the overall hardcover on the lot was 22.5 percent was also a factor in the City <br /> Council's decision. Gaffron stated the City should get something in return for allowing the additional <br /> hardcover and that they should hold to the 25 percent standard. <br /> Bremer stated she has a concern about properly owners who, in the past,worked hard to get their <br /> properties into compliance and that now the rules are changing. The City should have a strong reason for <br /> either changing it or staying the same. Bremer indicated she also would like the ordinance to be voted on <br /> by all five council members. <br /> Gaffron indicated it is StafPs intent is to have additional information to the City Council for their work <br /> session. <br /> Bremer stated she is not sure whether the City Council gave definite direction to pursue the tier option at <br /> the beginning of this process. <br /> Page <br /> 10 <br />
