� � <br /> ✓ r� <br /> Ptymouth City Code 915.01 � <br /> Section 915 � Ani ma! Control <br /> 915.01. Definitions. Subdivision 1. For purposes of this Section,the terms defined <br /> herein have the meanings given them. <br /> Subd. 2. "Owner" means any person owning, keeping,harboring or having custody of a <br /> • dog or other animal within the City. <br /> Subd. 3. "Public nuisance animal"means any animal to which any of the£ollowing <br /> conditions apply: <br /> A. Animals that are found on any property against the wishes of the owner of <br /> the property; <br /> B. An animal that damages the property of anyone other than its owner; <br /> ,. . <br /> C. Animals that are dangerous animals; <br /> D. Animals that cause unsanitary conditions of enclosures or surroundings as <br /> determined by the county health officer; <br /> � E. Animals that are diseased animals dangerous to human health; <br /> � F. Animals that bark excessively or make prolonged and disturbing noises <br /> interfering with the peace and quietude of the neighboring property; or <br /> G. Animals that have been determined to be strays. <br /> Subd. 4. "Stray" (used as a noun) means any unidentified and unattended animal which <br /> appears to not have an owner. (Ord. 2009-18, 11/10/2009) <br /> Subd. 5 "Unprovoked"means that the victim who has been conducting himself or herself <br /> peacefully and lawfully has been bitten or chased in a menacing fashion or attacked by a dog. <br /> Subd. 6. "Unreasonably clisturb the.peace and quiet"shall mean generally,.but is not <br /> limited to,the creation of any noise by any Animal which can be heard by any person, including <br /> a law enforcement officer or animal control officer, from a location outside of the building or <br /> premises where the Animal is being kept and which animal noise occurs repeatedly over at:least <br /> a five-minute period of time with one minute or less 1apse of time between each animat noise <br /> ,#i3� <br /> during the five—minute period. <br /> 915.03. Dutv of Animal Owners to be Responsible Owners. It shall be the duty of every <br /> owner of any animal, or anyone having any animal in his or her possession or custody,to <br /> . exercise reasonable care and to take all necessary steps and precautions to protect other people, <br /> property, and animals from injuries or damage which might result from his or her animal's <br />
