Planning Commission should note that whether to allow establishment of new existing <br /> - grades for accommodation of new homes is a site-specific and area-specific exercise. As <br /> can be seen in the CUP standards established in the Code for reviewing CUPs, <br /> compatibility with the character of the neighborhood is directly affected by what can or <br /> , will be built on a site as a result of the grade changes. In staff's opinion these potential <br /> future results must be taken into account in determining whether establishing a new <br /> existing grade is appropriate. In two recent actions,the City Council approved one such <br /> request and denied another, based to a great extent on the potential impact to the <br /> surrounding neighborhood. <br /> 2. For this application applicant have paid the penalty fee for the after-the-fact nature of <br /> the request (double application fee) and will be required to pay the double fee for the <br /> land alteration permit if approved. <br /> 3. Are there any other issues or concerns with this application? <br /> Staff Recommendation � <br /> Staff recommends approval of the after-the-fact conditional use permit for land alteration, and ��,;- <br /> concurrent establishment of a new existing grade for purposes of determining building height <br /> and number of stories. <br />
