MEMORANDUM <br /> Date: August 16, 2005 <br /> To: Ronald Moorse, City Administrator � <br /> From: Melanie Curtis, City Planner �����(/�/ <br /> RE: Jeffrey & Tracey Cordes <br /> 830 Forest Arms Lane <br /> Request for Home Occupation License Fee Refund <br /> On June 10, 2005, the Cordes' applied for a home occupation license to operate a <br /> landscaping business from their residential property at 830 Forest Arms Lane in response <br /> to a notification from the City regarding the commercial use of their property. Staff <br /> issued a notice to the property owners that their commercial use of the property was <br /> potentially prohibited, but the City Council would ultimately make the determination. <br /> Due to the fact that this application is the first of its kind to be brought before the City <br /> Council, staff did not have a definitive answer as to whether or not a landscaping <br /> operation would fall under the prohibited category in the minds of the Council. The <br /> applicants were advised that staff felt their use of the property was prohibited, but <br /> Council review was required. <br /> Because the license application was denied on the basis that the use is not eligible for <br /> such a license, it seems somewhat unreasonable for the Cordes' to have to pay for our <br /> learning experience. The City collected a fee of$100.
