MINUTES OF THE ORONO COUNCIL MEETING SEPTEMBER 11, 1989 <br />#1437 JOHN IDSTROM • <br />2580 FOX STREET <br />VARIANCE <br />RESOLUTION #2695 <br />Mr. Idstrom was present for this matter. <br />City Administrator Bernhardson informed the Council and <br />Mayor Grabek that the applicant wished to construct a barn nearer <br />the front lot line that the principal structure. <br />It was moved by Councilmember Callahan, seconded by <br />Councilmember Peterson, to adopt Resolution #2695, approving the <br />construction of an accessory structure nearer the front lot line <br />than the existing principal structure. Motion, Ayes =S, Nays =O, <br />Motion passed. <br />#1439 LAWRENCE LANGHANS <br />1366 REST POINT ROAD <br />CONDITIONAL USE PERMIT/VARIANCE <br />RESOLUTION <br />Mr. Langhans was in attendance of this meeting. <br />City Administrator Bernhardson provided a brief history of <br />this after - the -fact application for construction of a deck and <br />retaining walls. <br />Assistant Building and Zoning Administrator Gaffron said <br />that the City staff was recommending approval of the retaining <br />walls in that they are necessary to protect the banks from <br />further erosion. He also said that the remaining foundation <br />walls were serving the same purpose. <br />Mayor Grabek asked Mr. Langhans if he was aware of the fact <br />that a permit was required to construct the deck? <br />Mr. Langhans replied that he did not think a permit was <br />required to replace what was there. He said that if he were <br />going to put on a new structure he would have applied for a <br />permit. <br />Mayor Grabek asked what measures could be taken by the City <br />to assure that the deck would not be converted into a 3- season <br />porch? <br />Building and Zoning Administrator Mabusth replied that the <br />deck was a non - conforming structure subject to all pertinent <br />ordinances. Mabusth said that Mr. Langhans or a future owner of <br />the property would have to apply for a building permit and that <br />the Resolution would filed on the chain of title. <br />Councilmember Goetten expressed concerns about the stability <br />foundation. <br />• <br />of the concrete <br />City Engineer Cook said that he had not visited the site and <br />could not render an opinion at this time. <br />6 <br />
