• <br />MINUTES OF THE REGULAR ORONO COUNCIL MEETING JULY 10, 1989 <br />ZONING FILE #1420- NORWOOD CONTINUED <br />was initially going to assess the property for 3 sewer units, but <br />after a legal dispute, assessed 2. In 1975, Mr. Earl Norwood <br />requested to construct an accessory structure on one of the lots <br />not containing the principal structure. He was told that he <br />would have to combine the lots in order to proceed in that <br />manner. Mr. Norwood combined the lots and constructed the <br />garage. The City cannot confirm whether Mr. Norwood was advised <br />at that time that he would be limited in his ability to subdivide <br />in the future. The Planning Commission had recommended denial <br />with a 4 -0 vote. <br />Mr. Kevin Norwood said that he did not recollect that the <br />City had informed his father that future subdividing would not be <br />possible. Mr. Earl Norwood reiterated his son's statement and <br />added that he would never have combined the two lots had he known <br />that in doing so it would prohibit any future subdividing. Mr. <br />Norwood said that his house and garage currently sat on <br />approximately .6 acres and that he was happy with that. That <br />would leave approximately 1 acre for the additional lot. He said <br />that his neighbors were in favor of developing the additional <br />lot, mainly for aesthetic reasons. <br />• City Administrator Bernhardson questioned the amount that <br />Mr. Norwood was assessed. Gaffron reported that it was $1270.00 <br />per unit, plus a certain dollar amount for the front footage, for <br />a total of approximately $4400.00 for two units. <br />Councilmember Goetten said that she could not approve the <br />creation of a substandard lot. She said that to do so would be <br />precedent setting. She suggested that perhaps the City could <br />return the sewer assessment costs to Mr. Norwood as a fair <br />solution to the situation. <br />It was moved by Councilmember Goetten, seconded by <br />Councilmember Nettles, to refund the cost of the additional sewer <br />assessment to Mr. Norwood. Mayor Grabek asked whether Mr. <br />Norwood would be entitled to any added compensation. Bernhardson <br />replied that interest would be due Mr. Norwood as well and <br />suggested that he provide the Council with the total dollar <br />amount of the refund. Mayor Grabek asked if the motion could be <br />amended to conceptually approve the refund at this time and give <br />final approval when the total dollar amount is provided at the <br />July 24, 1989 meeting. Motion, Ayes =S, Nays =O, Motion passed. <br />#1422 DAVID BREITNER <br />2755 CASCO POINT ROAD <br />VARIANCE <br />RESOLUTION #2661 <br />• Mr. Breitner was present for this matter. <br />City Administrator Bernhardson explained that the the <br />Breitners were seeking approval of hardcover, lot width and lot <br />area variances to construct a new residence. <br />
