"_ � ? � <br /> ��.� ���� �.� ��G <br /> kESH�g' <br /> WHEREAS, the Applicant has made application to the City for a variance to <br /> Orono Code Section 78-1279(6) for an average lakeshore setback variance to permit <br /> portions of the proposed home to encroach closer to the lake than the adjacent residence; <br /> and <br /> WHEREAS, the Applicant has made application to the City for a variance to <br /> Orono Code Section 78-1608 to aliow a wetland buffer setback of 6 feet where a buffer <br /> setback of 20 feet is required; and <br /> WHEREAS, the Applicant has made application to the City for a conditional <br /> use permit per Orono Code Sections 78-966, 78-967 and 78-1286 for land alteration to <br /> conduct grading activity within the 0 to 75 foot zone and within the floodplain in conjunction <br /> with removal of the existing home and construction of the new home; and <br /> WHEREQS, after due pubiished notice and mailed notice in accordance with <br /> Minnesota Statutes and the Orono, Minnesota, City Code, the Orono Planning Commission <br /> held public hearings on February 21 and March 19, 2012, at which times all persons desiring <br /> to be heard concerning this application were given the opportunity to speak thereon. <br /> NOW, TNEREFORE, BE IT RESOLVED by the City Council of Orono, <br /> Minnesota: <br /> FINDINGS <br /> 1. This application was reviewed as Zoning File #12-3544. <br /> 2. The Property is located in the LR-1 A zoning district, where 2.0 acres is the <br /> minimum lot area and 200 feet is the minimum defined lot width. The <br /> homesite within the Property is approximately 0.69 acre in contiguous area <br /> and 140 feet in defined width. <br /> 3. The Planning Commission reviewed this application on February 21, 2012 and <br /> again on March 19, 2012, and on a vote of 6 - 0 recommended: <br /> a. Approvai of the variances, based on the following findings: <br /> i.
