MINUTES OF REGULAR ORONO COUNCIL MEETING JANUARY 9, 1989 <br />ZONING FILE #1296 PETERSON /STODOLA CONTINUED Is <br />It was moved by Mayor Grabek, seconded by Councilmember <br />Nettles to deny the After the Fact Variance by Peterson and <br />Stodo la. Motion, Ayes 5, Nays 0, Motion passed. <br />Administrator Bernhardson asked if the Council wanted staff <br />to draft an amendment to Chapter 5. Council directed staff to <br />amend Chapter 5. <br />ZONING AMENDMENT — <br />PLANNED DEVELOPMENT <br />Administrator Bernhardson stated that at the November 28, <br />1988 Council meeting staff had presented a list of items as a <br />follow up to an October meeting regarding a proposed amendment on <br />planned development. He noted for the Council that with the <br />Reber's property first there was a rezoning with a conditional <br />use permit and then a subdivision which was a two part process. <br />A planned development approach as proposed would put those <br />together in one item and would require a 4/5's vote so that <br />Council could deal with all the elements, both the rezoning and <br />subdivision elements in one package rather than dealing with part <br />of it in one place and one motion requiring a 4/5's vote and <br />coming through with a subdivision which requires a 3/5's or <br />majority vote. Additionally, Council always has the option of <br />repealing it particularly since there would be no particular area ' <br />zoning. The planned district would not be put on the zoning map <br />until such time that someone came forward for a rezoning. While <br />the idea is to allow more flexibility, it will get a better <br />product and will not lower the standards. Bernhardson suggested <br />that perhaps a good way to start with a planned development is to <br />start with the sewered areas and then consider the unsewered <br />areas. <br />Councilmember Callahan stated he believed the comprehensive <br />plan already addressed this issue. Councilmember Goetten <br />expressed her concern about this being applied to all of Orono. <br />Councilmember Callahan stated that the commercial area of Highway <br />12 would be the only application and concurred with Councilmember <br />Goetten. <br />Councilmember Goetten noted that the Planning Commission had <br />approved this on a 5/0 vote and wondered what their comments were <br />and why they had approved it. Mayor Grabek asked Planning <br />Commission member Jeffrey Johnson what the Planning Commission's <br />thoughts were regarding the planned development. Johnson stated <br />the Planning Commission liked the flexibility and control of the <br />planned development concept. <br />Mayor Grabek asked for more time to study this due to the <br />significance of this type of zoning. Administrator Bernhardson <br />stated that staff is seeking Council's direction. <br />It was moved by Councilmember Nettles, seconded by <br />Councilmember Goetten to table this matter for further study. <br />4 <br />
