They do conform • <br />with the required width to allow for emergency vehicle access. <br />Bernhardson asked Gaffron to confirm that the problems with this <br />application were due to Mr. Gumucio's agent. Gaffron affirmed <br />that observation and added that the - problem stemmed from a <br />misinterpretation of the City's codes. <br />Councilmember Goetten questioned the hardship that had been <br />indicated concerning the need for lighting: If indeed that was <br />the hardship, why then were the lights not being utilized? <br />Gaffron responded that there were integral lighting fixtures <br />halfway down each pillar that would be used immediately. The <br />applicant was asking that opportunity be reserved for the future <br />to place lights on top of each pillars should it be determined <br />that more light was necessary. Goetten stated that she was not <br />against the pillars, but she did not find the hardship to be <br />worthy. <br />Assistant Planning and Zoning Administrator Gaffron stated <br />that the pillars were up and they did 'not seem to be imposing <br />upon the surrounding area. The Planning Commission had <br />recommended., approval with a 4 to 1 vote. The one vote against <br />was due to a believed lack of any true hardship. <br />It was moved by Councilmember Nettles, seconded by Mayor <br />Grabek, to adopt Resolution #2516. Motion, Ayes =4, Nays =O, • <br />Motion passed. <br />11333 SIDNEY REBERS <br />715 NORTH BROWN ROAD <br />REZONING <br />RESOLUTION #2525 <br />City Administrator Bernhardson explained that this <br />application involved the rezoning of a 32 acre parcel of land <br />from the current rural, non - sewered 2 acre lot to a sewered 1 <br />acre lot. Mr. Steve -Pf laum and Mr. Robert Rost from BRW, were <br />present as respresentatives for Mr. Rebers, who was also present. <br />Mr. Steve Pf laum updated the City Council with respect to <br />the Rebers application. He informed them that the application <br />was being presented in two sections, the rezoning and the <br />subdivision. He reiterated Bernhardson's explanation of the <br />proposed rezoning. The project hinges upon the approval to <br />connect with a sewer interceptor. The Planning Commission had a <br />sketch plan review of both proposals and had recently approved <br />the rezoning application. There will be a number of conditions <br />that will be set forth in a developer's agreement. Prior to the <br />public hearing for the rezoning, Mr. Kost met with Planning <br />Commission Chairman Kelley and other Planning Commission members <br />for the purpose of making a list of items to be addressed at the <br />public hearing concerning the conditional use permit and PRD. <br />15 <br />
