• MINUTES OF REGULAR ORONO COUNCIL MEETING SEPTEMBER 28,1988 <br />CRYSTAL BAY ROAD CONTINUED <br />had been proposed. Grabek inquired as to how much that would <br />cost. Gerhardson replied, approximately $15,000.00 to put down <br />the sheathing and install the guardrail. The Mayor asked if that <br />would be acceptable to the applicants? The residents indicated <br />that they would not like to look at the guardrail. <br />Mr. Anderson asked if it would be possible to place a more <br />permanent "road closed" sign at each end of the street? That <br />would allow the snow fence to be taken down. The Mayor stated <br />that it was unfortunate that a guardrail would need to be <br />temporary installed, but if it was necessary to make the road <br />safe, so be it.- Mr. Schupp stated that he did not think the,City <br />could legally place a guardrail where they are intending. Mr. <br />Schupp stated that in lieu of the guardrail he would either work <br />with the City to bring his bank back up to a safe level; or he <br />would give the City a little bit or extra room so a shoulder <br />could be installed in that location. Public Works Director <br />Gerhardson explained that the guardrail was only temporary until <br />such time as Mr. Schupp repaired his bank. The posts for the <br />guardrail would then be cut off below ground level. Mr. Erger <br />proposed another plan wherein the City be granted an easement for <br />the purpose of working on the property until such time as a <br />retaining wall is built. The easement would then be vacated. <br />• Rather than bringing the blacktop right to the edge of the cliff, <br />why not comply with the normal grade by adding a dump truck of <br />dirt and create a more gentle slope. Then the residents could <br />bring their banks up to par. If there is a 20' retaining wall, <br />Mr. Erger is afraid that it would be impossible to bring in <br />enough dirt to sufficiently bring the bank back up. Public Works <br />Director Gerhardson stated that he would like the opportunity to <br />work out those details at a later time. <br />Councilmember Callahan interpreted his understanding that <br />this matter was to return to the Planning Commission to get their <br />input. Callahan suggested that Gerhardson and the residents work <br />together to reach a resolve before the Planning Commission <br />meeting. <br />Councilmember Peterson inquired as to whether the road would <br />be made into a private road if it is deadended. Gerhardson <br />replied that the road would not become private. He added that if <br />access off of the cul -de -sac was needed, from that point on, the <br />road would be private. Peterson asked about the 6 people with <br />the dirt road. Gerhardson replied that it would be those same <br />people. Peterson stated that she was talking about 2 different <br />roads, the dirt road and Crystal Bay Road. The property owners <br />with the dirt road. Gerhardson stated that those people would <br />have 2 accesses at this point. If the road were closed they <br />would just have a back access. If the residents did not obtain <br />• their right -of -way from Dakota Rail then they would not have a <br />legl access. <br />
