� MINUTES OF THE <br /> � ORONO CITY COUNCIL MEETING <br />" � Monday,February 13,2012 <br /> 7:00 dclock p.m. <br /> 9. #12-3540 CHARLES TRUWIT AND PAULA PICARD, 1105 FERNDALE ROAD WEST— <br /> VARIANCES AND CONDITIONAL USE PERMIT <br /> Charles Truwit, Applicant, was present. <br /> Curtis stated in 2009,the property owners applied for and received approval to redevelop the subject <br /> property in order to make it more saleable. The property owners have received annual renewals of those <br /> applications. The applicants have an interest in purchasing the property. With the exception of a few <br /> cosmetic changes to the property,they wish to construct what was initially approved. <br /> The applicants are proposing to slightly increase the size of the proposed footprint by 19 square feet over <br /> the previous approval. The proposed home consists of 3,409 square feet of structural coverage. A second <br /> floor continues to be proposed over a portion of the house, although the applicants are proposing to move <br /> it further west for a more central location. The change results in less massing for the adjacent lot. <br /> Also being requested is an increase in hardcover from 30.1 percent approved hardcover to 36 percent <br /> within the 0-75 foot zone. The hardcover numbers were recently adjusted by the applicant. The increase <br /> in hardcover being requested is primarily to allow a tear drop configuration of the driveway. <br /> The Planning Commission voted in January to recommend approval of a CUP and to recommend denial <br /> of the increase in hardcover. The Planning Commission had recommended approval of the hardcover <br /> variances with the removal of the proposed tear drop driveway. <br /> Curtis stated the colored overhead view reflects the Planning Commission's recommendation relating to <br /> the driveway. The Planning Commission recommended approval of the existing hardcover for the <br /> driveway with the exception of the green and red areas as well as the addition of hardcover to provide <br /> access to the front door. In addition, the Planning Commission recommended approval of the lot area and <br /> lot width variances, approval of the requested side yard setback variance, approval of the requested 75- <br /> foot lake setback variances, and approval of the CUP for grading within 75 feet of OHWL. <br /> � �. �Ca�1 @ <br /> Staff recommends appr �l of hardcover totali 8,0281square feet total.`The Planning Commission's <br /> recommendation add�56 ��are feet of additionaa-hardcover for a total of 32.2 percent. The applicants <br /> have agreed to plant addifiional shrubs or trees to screen the proposed lakes�'�3e�deck. Staff continues to <br /> recommend approval of the inclusion of a vegetative, shoreline buffer to infiltrate stormwater runoff <br /> along the southwest lakeshore area in the place of the proposed sod as illustrated on the landscape plan. <br /> The Council should discuss the various elements of the application and determine an appropriate level of <br /> hardcover for the property. In addition,the applicant should be required to provide a revised plan and <br /> revised survey prior to final Council approval. <br /> Rahn asked when Staff recommends approval of the 32.2 percent hardcover,whether that is more or less <br /> than what was approved in 2009 plus the 19 square feet. Rahn noted Staffs report states that 8,899 square <br /> feet was approved by Resolution 5841, but noted there was some swapping with the driveway. <br /> Curtis stated the front page of Staff's report shows the levels approved originally. Those hardcover <br /> numbers have since been adjusted to account for the removal of a piece of property belonging to the <br /> adjacent lot. Curtis noted the revised hardcover numbers have been adjusted on the second page of Staffs <br /> report, t�['Ch i he 8,028 square feet.
