Safar and Pam Safar, husband and wife (hereinafter "the <br /> applicants") are the owners of the property located at 980 Ferndale Road West within the City of <br /> Orono (hereinafter the "City") and legally described as follows: <br /> Attached as E�hibit A, (hereinafter the "property"); and <br /> �'HEREAS, the applicants have made application to the City of Orono for <br /> variances to Orono Municipal Zoning Code Section 78-1279 to allow construction of an addition <br /> ahead of the averaQe lakeshore setback, and the deck 45' from the OHWL and the addition as <br /> close as 50' to the OHWL where a 7�' setback is normally required, and <br /> WHER.EAS, the applicants have made application to the City of Orono for a <br /> variance to Orono Municipal Zoning Code Section 78-1608(3)(c) to allow construction of an <br /> addition within approximately 28' from the edge of the wetland where a 70' (SO' buffer + 20' <br /> structural setback from the buffer) is normally required, and <br /> V�'HEREAS, the applicants have made application to the City of Orono for a <br /> variance to Orono Municipal Zoning Code Section 78-1288 to allow 20°�o hardcover within the <br /> 0-75' setback zone where 0°ro is allowed and 19.5% currently exists in order to construct the <br /> addition. <br /> N0��4�, THEREFORE BE IT RESOL��ED by the City Council of Orono, <br /> Mimlesota: <br /> FINDINGS <br /> L This application was reviewed as Zoning File 09-3410. <br /> 2.
