MEMORANDUM <br /> To: Rachel Dodge, City Clerk <br /> From: Mike Gaffron, Asst City Administrator <br /> Date: March 17, 2014 <br /> Subject: Requested address change, PINS #02-117-23 43 0032 <br /> The above-referenced parcel is a triangular lakeshore parcel abutting Ferndale Road West and <br /> approximately 0.003 acre (+ 150 s.£) in area. The parcel contains a small shed (most of which is <br /> within the 66' right-of-way) and has for many years had a seasonal dock on Lake Minnetonka. <br /> Prior to 2006 this tiny parcel was non-existent as an individual entity in County tax records, but <br /> apparently in 2006 it was assigned a PINS number and assigned the address 960 Ferndale Road <br /> West. This address assignment most likely resulted because it was owned in common with the non- <br /> abutting 3+ acre homestead parcel on the north side of Ferndale Road West known as PINS #02- <br /> 1 17-23 44 0017, which has for many decades been addressed as 960 Ferndale Road West. <br /> The City has been advised that the homestead parcel (44 0017) previously owned by the Floyd <br /> family has been foreclosed and is now owned by Wells Fargo Bank. The tiny parcel (43 0032) was <br /> apparently not foreclosed and is still owned by the Floyd family. Wells Fargo intends to market the <br /> homestead parcel, but through its attorney has requested that the address of the tiny parcel be <br /> changed to something other than 960, so that there is no confusion on the part of potential <br /> purchasers as to what they are buying. <br /> Because the homestead parcel has been known as 960 for many decades and City and County <br /> records have long used 960 for this parcel, it would be in the best interest of all parties that the <br /> homestead parcel remains addressed as 960, suggesting that it would be appropriate for the tiny <br /> parcel to be assigned a new address. <br /> The tiny parcel is not buildable, does not contain and cannot contain a principal residence structure, <br /> and as such does not qualify for maintaining an accessory structure under City codes. Whether this <br /> parcel has potential grandfather rights to allow a dock to be maintained at the site is questionable. <br /> Its best disposition would be for the owners of 980 West Ferndale to acquire it, since they own the <br /> lakeshore on both sides of it. However, the City carinot force that to happen. <br /> To avoid future perception that the tiny parcel is still associated with 960 West Ferndale, its address <br /> should be changed to 975 West Ferndale Road. Per Orono Municipal Code Section 18-8(b), the <br /> City has authority to assign address numbers according to the standard numbering plan. <br /> Please process whatever paperwork and notifications are necessary to change the address of PINS <br /> #02-117-23 43 0032 to an address of 975 Ferndale Road West. <br />
