Sec.13.04 RIGH"1'S OF SUBJEC"i'S OF D,�T,� <br /> Subd. I. Type of data. 'fhe rights of individual on ti�hom the data is stored or to be stored shall be as set forth in this section. <br /> Subd.2. Information required to be given individual. An individual asked ro supply private or confidential data conceming himselfshall be <br /> infbnned ot`. (a)the purpose and intended use of the requesred data���ithin the collecting state agency,political subdivision,or state���ide system;(b) <br /> whether he may refuse or is legall�required to supply the requested data;(c)any known consequence arising from his supplying or refusing to supply <br /> private or contidential data_and(d)the identiry of other persons or entities authorized b}�state or federal law to receive the data. This requirement shall <br /> not apply when an individual is asked to supph investigative da[a.pursuant to section 13.82,subdivision�,to a law enforcement officer. <br /> The commissioner of revenue mav place the notice required under this subdivision in the individual income tax or proper[v tar refund <br /> instructions instead of on thosc forms. <br /> Subd.3. Access to data by individual. Upon request to a responsible authority,an individual shall be infonned whether he is the subject of <br /> stored data on individuals,and w�hether it is classitied as public,private or confidentiaL Upon his further request,an individual���ho is the subject of <br /> stored private or publ ic data on individuals shall be shown the data without any charge to him and,if he desires,shall be infonned of the content and <br /> meaning of that data. Atter an individual has been sho�vn the private data and infonned of its meaning,Nie data need not be disclosed to him for six <br /> months thereatter unless a dispute or action pursuant to this section is pending or additional data on the individual has been collected or created. The <br /> responsible authority shall provide copics of the private or public data upon request b� the individual subject of the data. The responsible authority <br /> may require the requesting person to pa}�the actual costs of inaking.certifi-ing,and compiling the copies. <br /> Ihe responsible authoriq�shall comply immediately,if possible.with any reyuest made pursuant to this subdivision.or�cithin five days ot� <br /> the date of the request,excluding Saturdays_Sundays and Iegal hol ida}�s,if immediate compliance is not possible. If he cannot comply�with the request <br /> within that time,hc shall so inform the individual,and ma_y have an additional five days widiin which to comply with the request_e�cluding Saturdays, <br /> Sunday�s and leeal holidays. <br /> Subd.4. Procedure�vhen data is not accurate or complete. An individual may contest the accuracy or completeness of public or private data <br /> concerning himself. To e�ercise this righC an individual shall notify in Nriting the responsible authorit}�describing the nature ofthedisagreemenL The <br /> responsible authoriry shall within 30 days cither (a)correct the data found ro be inaccurate or incomplete and attempt to notify past recipients of <br /> inaccurate or incomplete data,induding recipients named by the individual:or(b)notity[he individual that he believes the data to be correct.
