� O � � '� �° <br /> � / P; � �� <br /> � �, � <br /> �;,.;- , CITY of ORONO <br /> � � <br /> �� `�s�'' � p'�' RESOLUTION OF THE CITY COUNCIL <br /> �`�kEsH.o�`'� No. 5 � � `� <br /> A RESOLUTION GRANTING VARIANCES <br /> TO MUNICIPAL ZONING CODE <br /> SECTION 78-305(b) and SECTION 78-1279(1) <br /> FILE NO. 06-3217 <br /> WHEREAS, Craig Swansori and Larey Swanson, husband and wife, as <br /> owners and Tracy Constable, a single person, as prospective purchaser under Purchase <br /> Agreement dated June 6, 2006 (hereinafter the "Applicants"), of property located at 865 <br /> Ferndale Road West within the City of Orono (hereinafter the "City") and legally <br /> described as Lot 104, Auditor's Subdivision No. 184, Hennepin County, Mirulesota <br /> (hereinafter the "property"); and <br /> WHEREAS, the applicants have made application to the City of Orono <br /> for a variance to Orono Municipal Zoning Code Section 78-1279(1) to allow construction <br /> of a second story over the garage portion of a house that is located entirely within the 75 <br /> foot lakeshore setback; and <br /> WHEREAS, the applicants have made application to the City of Orono <br /> for variances to Orono Municipal Zoning Code Section 78-78-305(b) to allow <br /> constniction of a second story over the garage portion of a house that is located 17.6 foot <br /> from the east side property line when a 30 foot side setback is required. <br /> NOW, THEREFORE BE IT RESOLVED by the City Council of <br /> Orono, Minnesota: <br /> FINDINGS <br /> 1. This application was reviewed as Zoning File 06-3217. <br /> 2. The property is located in the LR-1 A, Zoning District which requires a <br /> minimum lot area of two acres and a minimum lot width of 200 feet. <br /> 3. The property is .5 acre and 100 feet wide. <br /> 4. The Planning Commission reviewed this application at a public hearing <br /> held on July 17, 2006 and recommended approval of the variances based <br /> on the following findings: <br /> Page 1 <br />
