MINUTES OF THE REGULAR ORONO COUNCIL MEETING HELD SEPTEMBER 28, 1987 <br />41188 KAPLAN CONTINUED <br />It was moved by Councilmember Callahan, seconded by <br />Councilmember Goetten, to table this application until <br />the October 12, 1987 Council meeting pending further <br />information from the City Engineer regarding drainage <br />and elelvations, and direct staff to draft resolutions <br />of denial and approval based on all factual information <br />submitted. Motion, Ayes 5, Nays 0. <br />#1189 JAMES MORTON <br />20 WEAR LANE <br />VARIANCE <br />RESOLUTION #2265 <br />Jim and Dorothy Morton were present for this matter. <br />City Administrator Bernhardson explained the request for <br />front yard setback variance to construct an in- ground <br />pool in front of the front line of the house. Planning <br />Commission recommended approval as proposed. <br />It was moved by Mayor Grabek, seconded by Councilmember <br />Sime, to adopt Resolution #2265 approving the variance <br />per staff recommendation. Motion, Ayes 4, Nays 0. <br />#1191 NED, INC. /GARY CARLSON /FRANK YUSUP <br />2220/2235 FRENCH CREEK CIRCLE <br />IFTER -THE -FACT CONDITIONAL USE PERMIT <br />RESOLUTION #2266 <br />Ned Dayton was present for this matter. <br />City Administrator Bernhardson explained the request for <br />an after - the -fact conditional use permit for a berm <br />constructed sometime in 1984 at the time site grading <br />was done. Planning Commission recommended approval of a <br />maximum 516" berm to remain. <br />Gray Printup, 1261 Briar Street, abutting property owner <br />east of Lot 6, stated that the issue arose when the berm <br />on Lot 6 was raised abruptly to 5'6" for approximatly <br />50' which was inconsistent with the intent and remainder <br />of the berm. He stated that the original 3 -1/2' - 4' <br />berm was acceptable to the abutting neighbors to the <br />east. <br />Staff advised Mr. Printup that the City Engineer is <br />recommending that the slope be regraded to provide a <br />more gentle slope and that ground cover be restored. <br />It was moved by Mayor Grabek, seconded by Councilmember <br />Goetten, to adopt Resolution #2266 approving the after - <br />the -fact conditional use permit per staff, City <br />Engineer, and Planning Commission recommendation. <br />Motion, Ayes 4, Nays 0. <br />3 <br />
